Michigan has implemented significant changes to its landlord-tenant law, effective November 6, 2023. At the initial trial date, courts must now verbally inform tenants of their rights, including the right to an attorney, proper venue, and jury trial. The eviction process has been modified with additional steps for default judgments and potential stays for tenants seeking rental assistance. New conditions for entering defaults have been established, requiring proper service and sufficient pleading. For nonpayment cases, proceedings must be stayed if the tenant applies for rental assistance within 5 days of being informed of their rights, with stays lasting up to 28 days. If a trial is adjourned, it must be rescheduled within 7-14 days. These changes aim to provide more tenant protections while establishing clearer procedures for landlords, who should familiarize themselves with these new requirements to ensure compliance in eviction proceedings.
