Another mistake many people make in their recovery from an accident is to assume that a procedure recommended by a doctor won't work because it's temporary. However, often temporary relief will show that other permanent treatment will work and sometimes the lack of temporary relief may indicate there is nothing else that can be done. The key is to ask questions so you understand the purpose of the procedure, the mechanism of the procedure and how long it may take before you know if it is going to work.

First mistake when injured in a car accident: Refusing EMS. If you're not sure if you've been hurt don't refuse EMS. By refusing EMS you're asking for "no injuries" to be written over all the reports. For some reason many people who aren't sure just want to get home and decide later. It looks bad for you and it could kill you. Get examined, follow medical advice and make sure you're okay.

Never operate a vehicle after consuming any alcohol or mind altering substances. If you are ever pulled over for DUI understand that everything the officer does is intended to generate evidence to be used against you at trial.

Among the first things you'll be asked is "Have you had anything to drink?" If you have consumed the slightest amount of alcohol the officer probably has already smelled it and a "No" makes you out to be lying to the police. If it's "Yes" then that's one step towards a Guilty. I recommend you state: "I invoke my right to remain silent." More questions will follow, but continue to provide that response. You are only required by law to produce your license and insurance but not to answer questions.

The officer will probably then direct you to "please step out of your car." This is where your constitutional rights conflict with not worsening your situation. You have the right to remain silent, and the more you talk if you've been drinking, the more evidence you're giving to the little camera on the officer's chest. I recommend that you ask; "Are you ordering me to exit my vehicle? Am I being detained or am I free to go?"

The officer will usually not answer the question but state "I want you to step out to perform some tests" These are field sobriety tests and you do not have to take them. No one should take them. Nothing happens to your license if you don't. Your response should be "I've invoked my right to remain silent and that includes taking tests." Again follow orders but make it clear you are not volunteering for anything.

So what happens from here? Don't actively resist and follow orders by the officers. Unfortunately because of what the officer observed prior to pulling you over, you're probably going to be arrested for DUI anyway and taken to the station for a breath test. I'll tell you about the breath testing next week but here's a summary what to remember:

1. Invoke your right to remain silent.
2. Refuse all tests.
3. Ask if you are being detained or required to do certain things. and
4. If the officer orders you to do something, comply with the request but make it clear you are not volunteering to say or do anything.

42 years of handling traffic cases. When you get pulled over you usually will get asked "Do you know how fast you are driving?" Your answer can either to lead to a speeding ticket or a DUI investigation. It is indeed a trick question. If you tell the officer how fast you were driving, that's evidence against you. If you tell the officer you don't know perhaps you are impaired. Your answer should be. "Officer I'm not giving statements and am exercising my right to remain silent." If the officer continues just continue to say "I am exercising my right to remain silent." (If you've consumed a beer or two this might be difficult as Ron White says; "I knew I had the right to remain silent but not the ability.")

Next week I'll tell you what to do next and why you should never answer other questions like where you are coming from or where are you going. Also why you should never participate in field sobriety tests because you don't have to.

Best way to find the best lawyer for you? Ask family, friends and people in your community, ask lawyers you know that you don't think do what you need, look at the court rosters for lawyers that appear on the dockets for those kind of cases or just call my office. If we don't do it, we'll tell you who's the best in our opinion. But don't base your decision on advertising, jingle's, slogans, celebrities, golfers, all something numbers, cute animals, flying lawyers, actors portraying actual clients, or big "judgments" or better yet actually research where these figureheads actually live and don't be surprised if it's Los Angeles.
