Trial Victory Forces Insurance Company to Cough Up Fair Settlement.

Sometimes the best negotiating tool in settlement discussions is to take the case to trial.

Our client Alberto Jijon worked for a company called M&M Interiors that was hired to perform drywall work on a construction project, which involved the expansion of a plant where nutritional bars were manufactured.

Shortly before his accident, Mr. Jijon and his co-workers were installing drywall in an electrical room, which included drywall over a framed-out doorway.

On several occasions, M&M’s foreman asked the general contractor on the project to install a door in that area so that workers could safely enter and exit the electrical room.

The general contractor’s project superintendent, however, denied this request because he had scheduled a city building department inspection for the following day and believed that he needed to completely seal off the electrical room in order to pass the fire code inspection.

If he failed or postponed the inspection, the project would be delayed, which would cost his company money. When M&M’s foreman asked how his workers were supposed to access the electrical room in order to perform their work, without a door, the project superintendent’s response was, “Do the best you can.”

In short, the general contractor sacrificed worker safety in order to save time and money.

From the beginning, has handled a limited number of complicated cases involving serious physical and emotional injuries, wrongful death, and insurance bad faith. This tradition continues today. We consistently take on challenging cases that other lawyers turn down or cannot handle. A big part of our practice now includes sexual abuse cases, including cases against child protective services agencies that have failed to protect children from sexual predators or other abusers. We recently obtained a $10 million settlement from the County of Riverside, which is believed to be the largest sexual abuse settlement on behalf of a single plaintiff in California history.

SETTLEMENT: represented seven women who were sexually abused and harassed by a gynecologist.

Seven women were sexually abused and harassed by gynecologist , who was associated with UCLA for over 30 years as a physician and medical school faculty member. The university allowed Dr. Heaps to quietly retire in June 2018 while a sexual misconduct investigation was underway, and the public did not learn of his decades-long history of misconduct until a year later.

Just over a year after 8-year-old Sophia Mason’s body was found decomposing in a bathtub in central California where her mother and mother’s boyfriend had lived, her grandmother filed a lawsuit against Alameda County, alleging that social workers refused to investigate numerous child abuse claims made in the 14 months leading up to her death.

Sophia’s aunt, Emerald Johnson, reported Sophia missing on March 8, 2022, after telling Hayward, Calif., police that she had not seen the girl since December 2021. On March 11, 2022, Merced police discovered Sophia’s body in the bathtub of a locked bathroom in a home where Sophia had been staying in Merced with her mother, Samantha Johnson, 31, and her mother’s boyfriend, Dhante Jackson, 34. Officials said that by the time police found her, she had already been dead for about a month.

Johnson and Jackson have been charged with murder and felony child abuse, and remain in custody at the Merced County jail while they wait for an evidentiary hearing set for early June. Johnson has pleaded not guilty to the charges.

“Her mother had a difficult life and perhaps some mental or intellectual disabilities, but she did not display a great amount of interest in Sophia for most of her life,” Carly Sanchez, an attorney for the grandmother, Silvia Johnson, told Yahoo News. “So grandma stepped in to take care of her and raise her.”
