What can I do if my restraining order expired? If you had a Domestic Violence Restraining Order (DVRO) in California and it expired before you filed a renewal request with the court, the court cannot “reinstate” it once it lapses. Under Cal. Fam. Code § 6345(a), a DVRO can be renewed for 5 years or permanently only if the request is filed within the three months before the order ends.

If a protected party’s restraining order has already expired, the party can still file a new Request for DVRO. The judge will consider whether there is evidence of past abuse (Cal. Fam. Code § 6300) and whether protection is still needed. This means the person seeking protection will need to re-establish their case, but past incidents of abuse (even if they happened years ago) may still be considered.

Key takeaway: While DV and abuse survivors can’t renew restraining orders that have already expired, they don’t lose the right to seek protection: they’ll just need to file for a new DVRO request.

📄Form-Preparation Help: In California, court Self-Help Centers sometimes provide language assistance when filling out forms. But this depends on the availability and language skills of the staff and volunteers. It’s not guaranteed in every location or for every language.

⚖️Court hearings: California law guarantees the right to an interpreter in certain court proceedings. If a party needs an interpreter for a family law or domestic violence case, they can request one by filing Form INT-300 (Request for Interpreter) with the court. The court will then assign a certified or registered interpreter at no cost to the party.
