MYTH: My power of attorney lets my agent handle things after I die. FACT: A power of attorney ends at death.

A power of attorney lets someone act for you while you're living. When you pass away, that authority stops, and your estate is handled by a personal representative or executor appointed through probate. That's why a complete plan includes both a power of attorney and a will.

Let's make sure your plan covers both. Call or text (912) 200-7785, or visit www.Batten.Law to schedule a consultation today.

MYTH: If there's a will, you can automatically skip probate. FACT: In Georgia, a will generally has to be probated before the executor can act on it.

A will says who should receive real property and personal belongings upon one's passing. Probate is the court process that gives the executor legal authority to carry out those wishes. This gives the executor the ability to transfer title to real property, sell assets if needed, and pay estate debts.

However, there are certain cases where probate may be avoided. Certain estates may not require probate. Some assets, such as accounts with a named beneficiary or jointly owned property with survivorship, may pass outside probate.

Not sure what fits your situation? Call or text us today to get help forming a clear plan of action.

Hi, I’m Wendeline S. Batten. Since opening Batten Law in 2015, I’ve been honored to help countless Georgia residents with their estate planning and probate needs.

This work is deeply meaningful to me. I’ve experienced the deep pain of loss myself, and I’ve seen firsthand how an unclear estate plan or will can leave a family scrambling.

My goal is to help you create a clear, straightforward plan for yourself and your family. Every will I draft is customized to fit your wishes and needs, never a boilerplate form. Every client and every family is different, and your estate plan should reflect that.

On a personal note, I was born and raised in Raleigh, North Carolina. My husband, Burke Batten, and I have three beautiful daughters and a dog named Monty. We love spending time outdoors, playing tennis, and finding the beauty of God's creation in each day.

If you have questions about your estate plan or a probate matter, please call or text me at (912) 200-7785. I’m happy to help with any question, big or small.

Probate doesn't have to make going through grief and loss harder. There are several types of probate and estate administration that may be utilized in Georgia. Here is what the Georgia probate process looks like for the majority of our clients:

1. File a petition with the probate court in the county where your loved one lived.
2. The court appoints a personal representative (an executor or administrator).
3. Notice to creditors is published once a week for four weeks. Creditors then have three months to come forward.
4. The estate is inventoried, debts and expenses are paid, and what remains is distributed.

Every estate is different. If you have questions about your family's situation, Batten Law can help.
