On today’s issue of “Sunday law,” we explore the world of Wills.

So, recently, I saw that my local bank was offering “free Wills” to its customers. Curious, I looked at the terms and conditions. Well, you might as well do it yourself, which is a bad idea. No one actually represents you and the costs are subject to your needs. Lots of disclaimers. Free. Ha ha. (I wonder whom will show up to court if there is a Will contest, which is a very expensive and avoidable lawsuit where family members fight over an estate?).

What the heck is the purpose of a Will? Well, either you have it or your family might suffer needlessly after you are gone. Without one, the estate might need a bond (a costly insurance policy), the costs to probate are higher, and your estate is subject to the laws as set by your friends in the government.

I have had to have the conversation many times about bonds, and that a surviving spouse doesn’t necessarily take all. That is really a shocker to a grieving spouse.

Do yourself a favor this holiday season: give us a call. Do not delay. Protect your family. Plan to avoid probate and for Medicaid qualification. Talk to us about advanced directives to avoid more costly issues, like guardianship.

Protect.your.family. Hard stop.

We hope you enjoy these posts which are food for thought.

As a homeowner, you sometimes have to hire a contractor to help with an issue. Plumbing, electrical, roofing. It is expensive but necessary for your biggest investment. But sometimes things go sideways.

Before you hire: check out whether your local city or township has a requirement that contractors register. Check out their online reviews.

Most importantly, make sure you get it in writing in a signed contract!

The scope of work, the timeline, the cost. There are many issues that need to go into a construction contract. Because if you don’t sign a proper contract, you might have an issue that will set you up for foreclosure. Yes, foreclosure—from a mechanic’s lien! And definitely a lot of heartache.

If you need to ask questions about construction work, let us know. It is better to measure twice and cut once.

Many people ask me: what kind of lawyer are you?

Well, the answer lies not in the types of law I practice, but my philosophy about the law.

I remember back in law school Judge Mary Caciopo came and talked to our class. She was a graduate of the then Akron School of Law (now the University of Akron School of Law), clas of 1945. Judge Caciopo was a lawyer of many firsts. She said that to be a good lawyer you have to love the law.

Indeed I do, and I identify as a Constitutional Conservative dedicated to the rule of law as written, and have dedicated more than twenty years to upholding the law.

The time: December 31, 2014.

The place: our former office in Fostoria at the historic First National Bank building. The picture was taken at dusk, and does not really do justice to the beauty of that particular sunset.

The sky seemed to be on fire that night in a way I had never seen before or since. Much has changed since then. Our office is now in Tiffin, the county seat of Seneca County, and our beloved home town now.

My many thanks to our clients and to our courts for their support in 2024.

It’s a little secret that since 2007 we have recovered almost $1 million for clients hurt through wrongful death and personal injury. These were a handful of cases.

The missing piece is the folks who are hurt through medical negligence.

To that end we will be looking to eventually offer our services to those hurt by negligent doctors.

I will take supreme satisfaction in this endeavor.
