Importance of having a gun trust created -

For Texas gun owners, fi****ms are more than just tools—they’re family heirlooms, investments, and a cornerstone of personal freedom. But what happens to your fi****ms when you’re no longer around? Or if something unexpected happens that prevents you from possessing them legally? Without proper legal planning, your loved ones could face serious legal issues, especially when it comes to NFA (National Fi****ms Act) items like suppressors, short-barreled rifles, or machine guns. That’s where a gun trust comes in.

What Is a Gun Trust?

A gun trust is a special type of legal entity created to own and manage fi****ms—particularly those regulated under the NFA. But its benefits go beyond just handling NFA items. A well-drafted Texas gun trust can also help manage and transfer non-NFA fi****ms, ensuring they are passed down legally and safely to your heirs.

Why You Need a Gun Trust in Texas
1. Protects Your Family from Unintentional Felony Charges
Federal and Texas laws are strict when it comes to possession and transfer of NFA items. Without a trust, your spouse or children could unknowingly commit a felony simply by having access to a firearm they aren’t legally allowed to possess. A trust clearly outlines who is allowed to use or possess your fi****ms, reducing legal risk.
2. Simplifies Transfers After Death or Incapacity
Probate can be a long and messy process—and it gets even more complicated when guns are involved. A gun trust allows for a smooth transition of fi****ms to your designated beneficiaries, without waiting on probate or dealing with legal gray areas.
3. Allows Multiple Responsible Parties
A gun trust allows you to name co-trustees—like your spouse, children, or close friends—so they can legally possess and use NFA fi****ms without having to wait months for ATF approval. Everyone named in the trust is covered under the same legal protection.
4. Preserves Family Legacy and Values
For many Texans, passing down fi****ms is about preserving heritage and teaching future generations responsibility and self-reliance. A trust makes sure those values—and those fi****ms—stay in the right hands.
5. Provides Privacy
When fi****ms are passed through probate, they become a matter of public record. A trust keeps your fi****ms and your plans for them private, as they are handled outside of probate court.

Don’t Wait Until It’s Too Late

The legal landscape around fi****ms is always changing. What’s legal today might not be tomorrow. Having a gun trust in place gives you a structured, legal way to manage your fi****ms now—and ensures your loved ones can inherit and enjoy them legally in the future.

Whether you own a single hunting rifle or a collection that includes suppressors and SBRs, a Texas gun trust is a smart and responsible step. It’s about more than compliance—it’s about protecting your rights, your family, and your legacy. Call us today to assist with creating your firearm trust - 713-818-7116

At White & Mejías, PLLC, estate planning isn’t just legal work—it’s personal.

If you’ve ever had to settle the affairs of a loved one after they passed, you know how overwhelming it can be. We’ve been there too. That’s why we’re so passionate about helping Texas families plan ahead—because we’ve seen firsthand how much peace of mind it brings during difficult times.

Here in Texas, if someone passes away without a will, their estate is distributed according to state intestacy laws. That means the courts—not your family—decide who gets what. This can lead to unintended outcomes, delays, and even conflict among loved ones. And if minor children are involved, it’s even more crucial to have a plan in place for guardianship.

Estate planning isn’t just for the wealthy or elderly. Whether you’re a young parent, a small business owner, or enjoying retirement, your estate plan is your voice when you’re no longer here to speak for yourself.

With a solid estate plan, you can:
• Ensure your wishes are honored
• Protect your loved ones from legal stress and financial burden
• Appoint guardians for your children
• Avoid unnecessary probate costs and delays
• Make sure your legacy lives on, exactly the way you want it to

Let us help you create a plan that reflects your values, protects your family, and gives you peace of mind. We’re not just here to help with documents—we’re here to help you plan a future that brings comfort, not confusion.

Ready to talk? Message us or call 713-818-7116 to schedule your consultation. It’s never too early, and it’s never too late.

Your future deserves a plan. Let’s build it together.
