Thanks again to Partners Resource Network for having me out to speak on special needs planning. It has quickly become a practice area I’m deeply passionate about and love nothing more than seeing parents have peace knowing their children’s futures are protected.

Robots are only as good as the information you give them. And trust me, you didn’t go to school to learn what information to give them.

Your will does not control your 401(k).

It doesn't control your IRA, your life insurance, or most annuities either. Those pass by beneficiary designation — a form you filled out, possibly decades ago, that overrides whatever your will says.

Before I practiced law I was a financial advisor, and this is the thing I watched go wrong more than anything else. Not fraud. Not a contested will. Just a form nobody had looked at since the divorce.

So here's what I'd ask you to do this week. Log in to every retirement account and every insurance policy you have. Look at the primary beneficiary. Look at the contingent. If either one surprises you, you have your answer about whether your plan is current.

It takes twenty minutes and it costs nothing.

Nobody grows up wanting to be an elder law attorney.

I started out as a financial advisor. I spent my days building retirement plans — projections, allocations, the whole thing. And the longer I observed family planning, the more I realized how fascinating it is.

To be honest, I'm passionate about making sure 1. the government doesn't get more of your money than they would, and 2. that your legacy is not marred by the stress and chaos that can come with your passing.

So I went to law school.

My wife and I changed the course of our entire lives but it was worth it. We moved back to her hometown, bought a hobby farm, adopted our daughter, and I get to do what I love.

Combining my history of financial planning and know the knowledge base of elder law means a legacy of security and peace for my clients. Somebody spent forty years building something and wants to know it'll land where they meant it to. I just have more tools to do that now.

In Texas, if you die without a will, your stepchildren inherit nothing.

Not a reduced share. Nothing.

I bring it up not to alarm anybody but because it catches good families completely off guard. You raised that child. They call you Dad. You were at every game and every graduation. But intestacy law — the rules that apply when there's no will — follows legal relationships, not the ones that actually did the raising.

There are two clean ways to fix it: name them in your will, or legally adopt. Both work. Doing nothing does not.

If you have a blended family and you've been meaning to get your documents sorted, make it this month.
