What happens to the marital home during divorce? Depending on your circumstances, it may be sold, one spouse may buy out the other’s interest, or an agreement may allow continued joint ownership for a period of time.

Massachusetts courts aim for a fair division of the overall estate, rather than an automatic 50/50 split. They consider the marriage’s length, each spouse’s finances and contributions, including homemaking and the children’s needs.

Keeping the house also means addressing the mortgage. Removing a name from the deed does not release that person from the loan. Before agreeing to a sale or buyout, consider the home’s equity, mortgage obligations, and ongoing costs.

Our team can help you understand your options and the financial implications of each. Book a consultation.

Thinking about a prenup or postnup in Massachusetts? A signature alone doesn't make it enforceable.

Courts look at disclosure, voluntariness, and whether both spouses understood what they were giving up. If you're considering an agreement, or questioning one you've already signed, our team can help.

In Massachusetts, a man is legally presumed to be a child's father if he was legally married to the mother when the baby was conceived. That presumption typically affects birth certificates, parental rights, and responsibilities like child support, but it can be contested in court-often through DNA testing-to determine biological paternity.

Married at conception? Here’s what Massachusetts law presumes.

Mediation offers a structured, confidential space where a neutral mediator sets ground rules, ensures respectful dialogue, gives everyone time to speak, and keeps discussions focused and safe—so sensitive issues can be addressed without escalation.

The aim is to explore issues, understand each person's concerns, and craft solutions that reflect shared interests. Mediators use active listening, reframing, and interest‑based negotiation to identify needs and create practical options—like parenting plans, schedules, or shared decision agreements. Research and practitioners report higher satisfaction and better follow‑through with mediated agreements than with adversarial processes.

Mediation doesn’t impose decisions; it creates a collaborative process where participants control outcomes while the mediator facilitates. It helps preserve relationships, reduces stress and cost compared with litigation, and builds communication skills to prevent future conflicts.

Mediation creates a safe, structured space for families to talk, understand one another, and find practical solutions.

In Massachusetts, if a property was purchased with marital funds, it is generally treated as marital property and may be subject to equitable distribution in a divorce—even if the title is in one spouse’s name. Exceptions can include valid prenuptial or postnuptial agreements, inheritances or gifts to one spouse, and certain transmutations of assets. For specifics in any individual situation, consult a family law attorney.

In MA, property bought with marital funds is typically marital property and may be divided in divorce.
