Do you know that a Texas Notary Public cannot interpret, draft, or provide advice on the contents of a legal document unless the notary public is a licensed attorney? Doing so can constitute what is known as “unauthorized practice of law” or UPL.

Sometimes, customers will ask me for assistance in obtaining or completing documents such as wills, contracts or a power of attorney. Customers may assume that I am experienced in the preparation of these types of documents and that I can provide the assistance requested. Unfortunately, Texas law prohibits me or any other notary public from giving advice, or from the rendering of any service requiring the use of legal skill or knowledge (see Section 81.101 of the Texas Government Code). This includes things such as preparing a will, a contract or other types of legal instruments. This law is intended to protect you from the loss of money, property or liberty.

If you are looking for someone to notarize your important documents, then I can help you. I welcome the opportunity to be your notary public of choice.

Most of my friends know that I am a mobile notary public in Texas and I love what I do. As part of my professional network, I work with a team that provides estate planning education. You might ask, "why is estate planning important?" I am glad you asked! Think about this.

Something bad has happened. You got sick or got involved in an accident, regardless you are incapacitated and can no longer manage your affairs (make financial or medical decisions for yourself.). What documents or permission slips do you not only have in place but you also have them on file with all the firms that you do your money business with relieving the financial firms of liability for allowing your spouse, business partner, adult child or friend, to access your retirement accounts, make a business or real estate transaction, or a medical decision on your behalf?

Having a Last Will is a good start but that only comes into play when you leave this world. If you have not thought about this, maybe now is the right time before something happens. Send me a message and I can refer you to the team that does these FREE educational sessions. They do free webinars on Wednesdays. There is NO COST and there is no pressure at all. You will not be asked to provide any personal information. Just listen, ask questions and then YOU decide whether you are ready for the unexpected.

In the past, if someone needed to have a document notarized they would either look for someone who had an office with a Notary Public sign displayed on the window or door, or they would go to their local bank or credit union and ask a notary there to notarize their document. Today, in addition to having the option to visit the notary public located in an office or bank, people now have the choice of having a notary public come to them. These are called Mobile Notaries and they can come to your home, business or other public location to notarize your documents. There are also Remote On-line Notaries (“RON”) that have special credentials and training to conduct your notarization through an internet video connection. No matter which type of notary you seek out to notarize your documents, one thing will not change. In Texas, the signer of the document must still present to the notary public a valid unexpired state or federal ID (driver license, state ID, or passport) that contains a picture and signature so make sure your ID has not expired. If you have any questions about notarizations, please reach out via [email protected] or visit our website at

According to the Legislative Reference Library of Texas (LRL) many new bills passed during the 88th Texas Legislative Sessions will go into effect on September 1, 2023. A total of 774 bills and individual sections from 19 additional bills are scheduled to become law on this date. One of these bills is HB 255 which applies to Notary Publics and addresses an increase in the maximum fees a notary public can charge for notarial acts. Here is a nice summary provided by the American Association of Notaries of HB 255.

Being a lifelong learner and always in pursuit of new opportunities, I decided to enroll in a certification program to become a Certified Notary Trust Delivery Agent (CNTDA). Took the course and the test and became certified. So, what is a Certified Notary Trust Delivery Agent? Well, thank you for asking. A CNTDA is a credentialed notary that has undergone advanced training and testing to better serve the public and estate planning professionals in the skillful presentation and ex*****on of trust documents.

By the way, do you or someone you know need to work on estate planning documents? Reach out to me and I am happy to provide the name of an excellent company that offers these services across all 50 states. They will not push you into purchasing anything and will even offer free initial consultations. They also provide free webinars loaded with helpful information. All of this without the high cost you would incur with a legal firm or attorney.

In the meantime, I am now expanding my services to include estate/trust documents. I don't prepare them; I only present and notarize them.

A nice article from the National Notary Association regarding another way to notarize documents. You may already be familiar with in person notarizations where you are present with the notary (same place, same time) and notarizations done remotely via what is known as Remote On-Line Notarizations (RON) which gained in popularity during the COVID pandemic. Was is discussed in this article is IPEN which stands for in person electronic notarization.

While many states now allow remote notarizations, you may not know about another electronic process allowed in some states — in-person electronic notarization. http://bit.ly/3zXvrm5
