I love the ocean, many due. The stakeholders of coastal environments are vast. From surfers to fishers, from environmentalists to oil producers, from tourists to locals, all claim their interest is the most important. I talk with Mark Massara, a leading attorney on coastal law, about who actually owns the waves and much more.

Send us Fan Mail A beach looks simple until you ask one question that changes everything: where does private property end and public access begin? We sit down with Mark Massara, a “surf lawyer” who has spent decades inside California coastal law, land use fights, and environmental regulation. Fr...

Arizona has a water problem (i.e. we never have too much). We are constantly searching to find new sources, constantly taking from farmers and native tribes, and constantly tapping the ground for more. So, when the Maricopa County Superior Court ruled against the Arizona Department of Water Resources, my ears perked up. Michele Van Quathem, an attorney who knows much more than I do about water resources and water law, set me striaght about the ruling and where Arizona needs to position itself for water in the future. Listen here:

Send us Fan Mail Arizona’s housing growth just ran into a question that’s bigger than any one subdivision: who gets to change the rules for water, and how? We sit down with Phoenix water law attorney Michele Van Quatham to unpack a trial court ruling in Home Builders Association of Central Arizo...

AI is change, but does it need to be scary? I talk with Eran Kahana, a research fellow at Stanford Law School, about AI and how it is changing the practice of law. Listen to Eran's opinion here: https://www.evenlegal.com/episodes/can-ai-replace-human-counsel/. My opinion: AI will change where we need lawyers to practice law, it create more law, it increase the pace of law, but will not replace lawyers.

Send us Fan Mail ChatGPT can draft a motion in seconds, but what happens when the motion is polished nonsense and a real person signs it? We bring on Eran Kahana, a practicing attorney and Stanford Law School research fellow, to unpack a lawsuit that claims OpenAI caused harm by enabling AI generate...

No one likes an activist judge, right? But what happens when the court refuses to second guess the legislature? Can that harm the people? I talk with David Williams about a recent AZ Supreme Court decision that could result in more deed theft. Reason: because that’s the way the law is written and the legislature needs to fix the law.

Send us Fan Mail A forged deed, a ticking clock, and a court that says the fix belongs to lawmakers—this conversation goes deep into how Arizona’s property laws shape real lives. We walk through Dominguez v. Dominguez, where a recorded deed alleged to be forged collided with a five‑year statut...

I had an interesting discussion with Nathaniel Preston regarding the Arizona Supreme Court's Alternative Business Structures, which are legal entities that allow non-lawyers to own, manage, or invest in law firms. This is a uniquely Arizona idea and has been controversial. Listen in to see Nathaniel's perspective on how it impacted personal injury.

Attorneys have the best stories. It's true. We see people's lives at their most raw, most vulnerable, most low, and most triumphant. Our clients' stories become our stories as they affect our lives in ways that is hard to explain. Taylor Barlow, a fantastic litigator, took on a pro bono case of a lifetime--political intrigue--two continents--an immigrant's literal fight for survival. Listen to the story here. https://www.evenlegal.com/episodes/how-a-pro-bono-case-changed-lives-across-continents-an-asylum-victory/.

Yesterday, we had victory in a civil jury trial involving an alleged land development agreement with our probate estate client! What does it take to win? Well, teamwork to start, but it was more than that. There was nearly two years of relentless work—motions, depositions, witness interviews, thousands of documents reviewed, countless hours of legal research, five intense days in trial, weeks of preparation, late night filings, documents to organize, more than one sleepless night, and, of course, plenty of caffeine. Hard work pays off! Credit to the team Angelika Doebler, Stephanie DeBuhr, and Miles, PLLC
