Appointments for the next Legal Aid Clinic from the Oakland County Legal Resources Center on Wednesday, October 19 will be accepted today, October 18, between 9 a.m. and 4 p.m. by phone at 248-858-0012.
The free virtual clinic is for low-income individuals seeking legal assistance with civil, non-family issues. Attorneys from Legal Aid and Defender Association, Inc. will provide participants with information on their rights, court procedures and forms, and in some cases, represent them in court.

Beginning October 1, 2022, the general public will no longer have immediate access to divorce complaints filed in Michigan trial courts.
Under the new Public Act 175 of 2022, divorce filings will not be accessible until after the proof of service has been filed with the trial court. Nonetheless, divorce complaints will still be accessible by an entity administering or providing services under Part D of Title IV of the Social Security Act, which pertains to Child Support and Establishment of Paternity, even when the complaint is still designated as nonpublic.

Governor Gretchen Whitmer Makes Appoints Amanda L. Eicher to 1st District Court (Monroe County). Eicher currently serves as the supervising attorney for Legal Services of South Central Michigan a division of the Michigan Advocacy Program. She earned her JD from MSU College of Law. The appointment was made to fill a partial term commencing Sept 6, following the appointment of Judge William Nichols to 38th Circuit Court.
On August 10, 2022, the Michigan Supreme Court issued ADM File No 2020-08, which becomes effective on September 9, 2022. This update retains the July 2021 amendments allowing for expanded videoconferencing and electronic filing. The order also rescinds some of the 2021 amendments, adopts new amendments of court rules, and adds new MCR 2.408.

The Small Business Administration (SBA) has issued a new final rule addressing the procedures for borrowers of a Paycheck Protection Program (PPP) loan to appeal final SBA PPP loan review decisions to the Officer of Hearings and Appeals (OHA).
According to the Rule, a borrower may appeal a “final SBA loan review decision,” which is described as an official written decision by the SBA finding that the borrower:
(1) Was ineligible for a PPP loan;
(2) Was ineligible for the PPP loan amount received or used the PPP loan proceeds for unauthorized uses;
(3) Is ineligible for PPP loan forgiveness in the amount determined by the lender in its full approval or partial approval decision issued to the SBA; or
(4) Is ineligible for PPP loan forgiveness in any amount when the lender has issued a full denial decision to the SBA.
Borrowers cannot directly appeal a lender’s decision concerning a borrower’s application for PPP loan forgiveness to the OHA and can only do so for an SBA decision. A borrower has 30 calendar days from the actual receipt of a final SBA loan review decision to appeal the decision.

OAKLAND COUNTY CIRCUIT COURT ANNOUNCES E-FILING EXPANSION
Oakland County, MI (April 10, 2020) – Beginning Monday, April 13, 2020, Oakland County Circuit Court will be expanding the e-Filing program to include Criminal cases and additional Domestic Relations cases. While e-Filing documents associated with these cases is not mandatory at this time, it is recommended by the Bench.
In addition to the current e-Filed cases, which include all Civil and Divorces Without Children (DO), the case types below will be added:
-Criminal (FC, FH, F Cases from 2017 forward)
-Domestic (including case initiation, DC, DM, DP, DS, DZ
Cases from 2015 forward).
-Misc. (including case initiation, ID Cases beginning 4/13/2020)

Thanks to new bipartisan legislation, DUI expungement in Michigan is now possible. On August 23, 2021, Governor Gretchen Whitmer signed House Bills 4219 and 4220, which will allow an estimated 200,000 people with one (1) drunk driving conviction to seek to eliminate it from their criminal record.
Only first-time offenders are newly eligible under the law change. Specific criminal convictions that may be expunged now include:
-Driving with a blood alcohol content at or above 0.08;
-Driving while visibly impaired due to any substance;
-Anyone who is younger than 21 driving with a blood alcohol content of 0.02 or higher;
-Driving under the influence of any amount of co***ne or another schedule 1 controlled substances.
DUI expungement recipients enjoy the wide benefits of a clear criminal record, which can include higher wages, better employment opportunities, better access to housing, more affordable insurance rates, access to student loans, and in some cases, a restored ability for Concealed Pistol License (CPL) eligibility.
Despite these benefits, nearly 95 percent of people eligible for expungement don’t even apply. Why? Because of the lack of knowledge about expungement law, and the complex process that awaits.

Zoom to pay $85 million to settle a lawsuit claiming it violated users' privacy rights, according to a preliminary settlement filed on Saturday. The class action suit by several Zoom users alleges the company shared personal data with Facebook, Google and LinkedIn, and allowed hackers to disrupt meetings with disturbing content in a practice called "Zoombombing."
The telecommunications company will not admit wrongdoing. If approved by a judge, subscribers would receive 15% refunds on their core subscriptions, or $25, whichever amount is larger.
On August 4, 2021, it was determined that the CDC had eventually classified Wayne County as an area under threat of “substantial” community transmission of COVID-19. As a result, both Wayne County and the City of Detroit are now included in the CDC’s latest eviction moratorium. Consequently, no residential evictions will proceed for nonpayment of rent in Wayne County or the City of Detroit when a CDC declaration order has been provided by the tenant to the landlord as detailed in the CDC’s August 3, 2021, order temporarily halting residential evictions in counties with heightened levels of COVID-19 community transmission.
The CDC's eviction moratorium now applies to Wayne County. The freeze covers U.S. counties with heightened levels of COVID-19 transmission.

A nationwide ban on evictions expires at midnight on July 30.
📢📢 New SCAO Forms Effective July 1, 2021 📢📢
In order to prevent identity theft, the Michigan Supreme Court requires that as of July 1, 2021, new forms MUST be used which do not contain Personally-Identifying Information (PII). Courts cannot accept the old versions of the forms after June 30, 2021.
As of July 1, 2021, PII must be listed on a new form, either MC 97 (Protected Personal Identifying Information) or MC 97a (Addendum to Protected Personal Identifying Information).

New expungement laws, called the "Clean Slate" bills, took effect on April 11, 2021. Expungements offer new hope to residents across Michigan by sealing records of eligible criminal convictions from the public, including from potential employers and landlords. Estimates of the number of people impacted by the changes range from hundreds of thousands to as many as 1 million.
A process to automatically clear certain misdemeanor and felony convictions without an application is in the pipeline. However, automatic expungement will be rolled out in April 2023 at the earliest, according to the State Court Administrative Office.
