A Florida Fact Information Sheet is a mandatory, court-sanctioned document used by creditors to identify a debtor’s assets after a judgment.

Debtors must complete and return this form, which details personal/business finances, income, and property, within 45 days to avoid further legal penalties, including contempt of court.

A debt collector may say you owe a certain amount, but that doesn’t make it true. Claims are just that, claims, until a court makes a final decision. There’s generally room for negotiation in litigation. We often negotiate a lower lump sum payment or manageable monthly payments. This can happen at mediation or before. Yes, debt collectors do actually ask me this, and most often, the answer is no. We try to get the best deal for our clients, depending upon the circumstances. This is not legal advice. Did you know your home insurance proceeds could be at risk if you have a judgment against you? Fortunately I was able to save my client’s insurance funds from garnishment today. It’s best to segregate the funds in a separate account labeled “Insuramce,” or something similar.
