Can a DUI be reduced to reckless driving?

Sometimes. But it is not automatic.

Whether a Florida DUI may be resolved as reckless driving can depend on the evidence, the circumstances of the stop, breath or blood testing, field sobriety evidence, video, prior history, and issues the defense identifies in the prosecution’s case.

The charge on the arrest paperwork is the beginning of the case, not necessarily the final outcome.

A DUI should be evaluated based on the evidence, not assumptions about what happens after an arrest.

Being released while a criminal case is pending does not mean the case is on hold.

A Florida law effective October 1, 2026 creates additional consequences for certain people on pretrial release for specified violent crimes who willfully violate particular release conditions. A violation can result in a separate criminal charge and being held until first appearance.

Release conditions should be taken as seriously as any court order. Before assuming something is permitted, understand exactly what the judge ordered.
