In most cases, your 403(b) plan IS protected from creditors and lawsuits. Here's why:

✅ Federal ERISA protections shield employer-sponsored retirement plans
✅ 403(b) plans typically have strong creditor protection
✅ Judgment creditors generally CANNOT seize these funds
⚠️ BUT , protections vary by state and plan type

Can a trust be contested? 🧑‍⚖️

Yes , but it's significantly harder to contest a trust than a will.

Trusts are private documents that don't go through probate court, which already makes them more difficult to challenge. But that doesn't mean they're bulletproof.

Here's when a trust CAN be contested:
⚠️ The creator lacked mental capacity when signing
⚠️ There was undue influence or coercion
⚠️ The trust wasn't properly executed
⚠️ Fraud was involved

Signing leases in your personal name when the property is in an LLC undermines the entire protection.

Commingling gives plaintiff's attorneys the argument they need to pierce the corporate veil and reach your personal assets.

Every lease: signed as LLC Manager. Every rent: deposited to LLC account. Every invoice: billed to the LLC.
