J.R.'s Daily Observation: One of the first things to do when an injured person hires you is to send a "Spoliation Letter" to any person or company that could have evidence necessary to prove your client's injuries or damages. If this evidence is not kept, or even accidently "lost", sanctions can be imposed later.

Since 1980, there has not been an increase in the minimum insurance requirement of at least $750,000.00 for 18-wheelers. The FMCSA considered an increase in 2017, but it never materialized. Now a proposed increase to $2,000,000.00 is being considered by the House of Representatives. Since Commercial Motor Vehicles can weigh up to 80,000.00 lbs., and travel at least 65 mph on the highway, most trucking accidents involve multiple vehicles, and the minimum insurance limits often don't begin to cover the injuries sustained.

FMCSA's insurance minimums proposal has been withdrawn. This effects commercial motor carriers, freight forwarders, and brokers.

J.R.'s Daily Observation: The Court's are now 10 months into Covid remote hearings via Zoom, and from time to time I still see attorneys casually dressed in attire they never would wear if appearing in person. Judge's keep internal their opinions based upon how attorneys handle themselves, and how they appear via Zoom is no different.

J.R.'s Daily Observation: "You can pay me now, or pay me later" A Washington motorist was injured, and his insurance company refused to pay the UM Benefits that he was due. He then filed suit against his Insurance company. Now National General owes him $950,000.00 rather than the $250,000.00 that they should have paid under his policy. A good Personal Injury Attorney knows that just because an insurance company says no, doesn't mean that's the last word.

J.R.'s Daily Observation: You indeed get what you pay for, just ask the estate of Ann Aldrich. Rather than pay an estate attorney to do it right, she used E-Z Legal Form, and got it wrong. Now the nieces she didn't mention in her will, are receiving part of her estate since the cheap form didn't account for all property in the estate. Considering how much the litigation must have cost, it would have been way cheaper to have a lawyer get it right.
