Clients always ask me how long it will take for their auto accident case to resolve, and unfortunately, I can never give them a clear answer. Each case is very different. However, you want to be sure that your attorney is giving your case the attention it deserves, so that things are not taking longer than they should. This afternoon I am filing a lawsuit for a client who was involved in an accident approximately 6 months ago. The client completed his medical treatment in a timely manner. As soon as he was done, I got my hands on the records as quickly as possible, and his demand went out the door within days. The first offer came in on April 5, and it was laughable. After a few follow-up calls to the adjuster, I was able to ascertain that this insurance company had no intentions of being fair and reasonable with my client. So why continue negotiating over the next 4 to 6 weeks? Why let my clients file sit, when I know there won’t be a fair resolution? That’s not how I do things. I immediately had a chat with my client and got the green light to file suit. It will be filed with the clerk before the end of the day, and in the process servers hands immediately thereafter.
I may not be able to control the defendants’ response, or whether or not they engage in good faith settlement negotiations. But I can certainly control when the lawsuit gets filed, and not waste anymore of my client’s time. That is the absolute minimum you should expect from your attorney in a personal injury case.
