Municipalities and law enforcement across Florida—including Hillsborough County's Operation Safe Passage program operated with vendor RedSpeed—are issuing automated $100 school zone speed camera citations.

Before paying a Notice of Violation (NOV) or Uniform Traffic Citation (UTC), note that recent Florida court decisions have identified key evidentiary requirements in these automated programs.

⚖️ Recent Florida Court Rulings on Speed Cameras
Two Florida County Court decisions demonstrate the importance of reviewing the evidence before resolving a citation:

Device Type-Approval (State v. Cardoza): Under Florida Administrative Code Rule 15B-2.007(1), speed-measuring devices used in Florida courts must be approved by the Department of Highway Safety and Motor Vehicles (DHSMV). In Cardoza, the court held that while the Legislature exempted cameras from traditional radar/lidar design criteria under Fla. Stat. § 316.1906(3), it did not eliminate the requirement for DHSMV device type-approval.

Inadmissible Hearsay (State v. Rives): In Rives, the court granted a judgment of acquittal because an officer’s verbal testimony reading owner information off a DAVID database search constitutes inadmissible hearsay under Fla. Stat. § 90.801. To establish ownership lawfully, the prosecution must present a certified copy of the official vehicle registration.
