A non-compete is easiest to deal with before it is triggered. Once a resignation letter is in, the terms are fixed and the timeline belongs to someone else.

Enforceability turns on the specifics: how the restriction is drafted, what state law governs it, what the employee actually had access to, and when the agreement was signed. Florida's CHOICE Act changed the analysis for agreements signed on or after July 1, 2025, and it does not reach every worker.

Jordan Behlman explains why the 14-day waiting period matters. Federal law gives you at least 14 days with the disclosure documents before you commit. Don’t let a salesperson or a “limited-time offer” cut it short. Read everything, ask questions, and walk in knowing exactly what you’re agreeing to.

Remember: 14 days is the minimum. Take as long as you need.

The FDD is the one document that tells you what you're actually agreeing to when buying a franchise. But it's long, technical, and comes with a deadline.

Under the FTC Franchise Rule, the franchisor must give you the FDD at least 14 calendar days before you sign or pay. That window exists so the document can be reviewed. Earnings claims made outside of Item 19 and promises that contradict what the FDD says are potential red flags worth investigating before signing, not after.

Overtime problems rarely announce themselves. They show up as a job title that does not match the actual duties, as prep or cleanup time that never reaches the timesheet, or as a bonus that was left out when the overtime rate was calculated.
