At a time of increasingly unpunished violations of international humanitarian law, there is a growing need for States Parties to the Rome Statute—of which the United States is not a member—to reaffirm their commitments to its provisions and corresponding norms, and to strengthen their cooperation with the International Criminal Court.

A French court has issued a significant ruling holding the Yves Rocher Group liable for failing to meet its obligations under France’s “duty of vigilance” law in connection with labor rights violations at its Turkish subsidiary. The case stems from the 2018 dismissal of more than 130 workers—many of whom had joined a trade union—amid allegations of unsafe working conditions, low wages, and sexual violence.

The court found that the company failed to adequately identify and prevent risks to workers’ fundamental rights within its global operations. While the decision marks an important step toward corporate accountability, many individual compensation claims were dismissed due to prior settlement agreements, making the outcome a partial victory for the affected workers and their advocates.

The ruling is being viewed as a landmark development in holding multinational companies responsible for human rights violations in their overseas subsidiaries.
