U.S. Trustee vs. Chapter 7 Panel Trustee

What’s the difference?

The names sound similar, but their roles are very different.

The U.S. Trustee Program is part of the U.S. Department of Justice and helps oversee the administration and integrity of the bankruptcy system.

A Chapter 7 panel trustee is the individual assigned to administer a particular Chapter 7 case reviewing financial information, conducting the 341 Meeting, and determining whether there are nonexempt assets available for creditors.

And neither one is the bankruptcy judge.

Bankruptcy has its own language. Understanding who does what is an important first step in understanding the process.

How Chapter 7 Bankruptcy Works

Chapter 7 begins when the debtor files a voluntary petition with the bankruptcy court, along with detailed schedules of assets, liabilities, income, and expenses. Once the petition is filed, the automatic stay takes effect immediately under 11 U.S.C. § 362, halting all creditor collection actions; lawsuits, garnishments, foreclosures, repossessions, and collection calls.

A bankruptcy trustee is then appointed to administer the case. The trustee's primary job is to review the debtor's assets, identify any non-exempt property, and if non-exempt assets exist liquidate them and distribute the proceeds to creditors according to the priority rules established by the Bankruptcy Code.

In practice, most Chapter 7 cases filed by individuals are "no-asset" cases, meaning the debtor's property is fully protected by available exemptions and there is nothing for the trustee to sell. The debtor keeps all their exempt property and receives a discharge of qualifying debts typically within three to four months of filing.
