Oklahoma Adopts the Uniform Trust Code – Big News for Trust Owners & Planners

Oklahoma just became the 37th state to adopt the Uniform Trust Code (UTC), bringing our trust laws more in line with the rest of the country. This new law takes effect November 1, 2025 and will impact how trusts are created, administered, and interpreted here in Oklahoma.

We’re already reviewing the changes closely to see how they may benefit our past, current, and future clients — and we’ll be sharing practical tips and strategies in the coming months so you can make the most of these updates.

In just the last couple of years, Oklahoma has made major strides in modernizing estate planning laws, including:

Allowing online signing and notarization of key documents.

Updating rules for digital assets and communications.

Expanding options for trust creation and administration.

It’s an exciting time for Oklahomans who want to protect their families, their assets, and their wishes.

📅 What this means for you: If you have a trust — or have been considering one — now is the perfect time to review your plan and see how these new laws might work to your advantage.

📝 What Exactly Is a Power of Attorney?

It’s one of the most important documents in estate planning—and one of the least understood.

A power of attorney (POA) lets you choose someone you trust to make decisions for you if you’re ever unable to.

There are usually two types:

💼 Financial POA – Handles bills, banking, property, taxes, etc.

🏥 Medical or Healthcare POA – Makes decisions about doctors, treatments, and end-of-life care.

Without one, your family may have to go to court just to help you.

We help clients create POAs that are:
✅ Clear
✅ Oklahoma-compliant
✅ Actually accepted by banks, hospitals, and institutions

📌 "3 Things You Can Do Today to Protect Your Family"

💬 Feeling behind on estate planning?
Start with just three simple steps—you can do them today:

1️⃣ Brainstorm a list of possible candidates you’d trust to handle your finances, healthcare, and care of your children if you (or you and your spouse) couldn’t.

2️⃣ Make a list of your key accounts and assets—bank accounts, insurance policies, real estate, retirement accounts.

3️⃣ Have a conversation with the people you’d likely lean on. Let them know your wishes, and ask if they’d be willing to help if the need ever arose.

None of these steps require a lawyer. But together, they form a strong starting point for a complete plan—and they’ll make the legal part easier when you’re ready.

🛡️ Planning doesn’t have to be overwhelming—it just has to begin.

Path to Peace of Mind: The Stages of Estate Planning

A guide to moving from uncertainty to confidence in your estate plan.

Many people start their estate planning journey with a vague sense that they "should do something" but aren’t sure where to begin. It’s a process—one that moves from uncertainty to clarity and peace of mind. Understanding where you are in this journey can help you take the next right step.

Stage 1: Awareness & Concern ("I Know I Need to Do Something")

📍 Where you are:

You’ve seen or experienced a difficult situation when someone passes away without a plan.

You don’t want to leave a mess for your loved ones.

You’re unsure of what estate planning involves or what you really need.

🚦 Common Actions in This Stage:
✅ Searching online for information.
✅ Talking to friends or family about estate planning.
✅ Considering writing down your wishes but not taking action.

🔍 Next Step: Recognize that while gathering information is helpful, informal notes and online templates may not hold up in real-life situations.

Stage 2: DIY & Informal Planning ("I’ll Try to Handle It Myself")

📍 Where you are:

You’ve started organizing documents, listing assets, and maybe even writing down wishes.

You’re considering using an online will service or free template.

You may have updated beneficiaries on accounts or titled property jointly to avoid probate.

🚦 Common Actions in This Stage:
✅ Using online legal forms or will-making software.
✅ Writing down instructions for loved ones.
✅ Adding family members to bank accounts or property deeds.

⚠️ Potential Risks:

DIY estate plans often miss critical legal details that could cause confusion or disputes.

Shortcuts (like joint ownership) may create tax problems or unintended consequences.

🔍 Next Step: Seek guidance to ensure your plan is legally sound and does what you intend.

Stage 3: Taking It Seriously ("I Want to Do This Right")

📍 Where you are:

You realize a solid estate plan is more than just a will—it’s about protecting your family, assets, and wishes.

You’re ready to take action but want to do it properly.

You’re weighing different options and professionals to help.

🚦 Common Actions in This Stage:
✅ Researching estate planning attorneys and services.
✅ Attending an estate planning seminar or webinar.
✅ Gathering financial records and family information.

🔍 Next Step: Schedule a consultation with an experienced estate planning attorney to develop a tailored plan that meets your needs.

Stage 4: Taking Action ("I’m Ready to Get It Done")

📍 Where you are:

You’ve made the decision to work with a professional to create a solid estate plan.
You’re ready to clarify your wishes and make legally binding decisions.
You want to ensure everything is structured properly for your loved ones.
🚦 Common Actions in This Stage:
✅ Working with an attorney to draft a will, trust, and other essential documents.
✅ Naming guardians, executors, and agents in case of incapacity.
✅ Understanding how different tools (wills, trusts, powers of attorney) work together.

🔍 Next Step: Follow through with execution—signing, notarizing, and organizing your estate planning documents.

Stage 5: Completion & Peace of Mind ("It’s Done—Now I Can Relax")

📍 Where you are:

Your estate plan is fully executed, legally binding, and aligned with your wishes.

Your loved ones will have clear guidance in the future.

You feel relieved, knowing that you’ve taken care of this important responsibility.

🚦 Common Actions in This Stage:
✅ Storing your documents securely and informing key people.
✅ Reviewing and updating your plan as life changes (marriage, birth, financial shifts).
✅ Keeping a digital and physical record for easy access.

🔍 Next Step: Periodically review and update your plan to keep it aligned with your life and wishes.

🚨 Do You Love Politicians? 🚨

Do you trust them to make the best decisions for you, your family, your pets, and your property? If you don’t take proactive steps to “opt out” of the state’s default rules, that’s exactly what will happen.

We live in a world where politics are everywhere—some people love a politician and hang on their every word, while others can’t stand them. But no matter how you feel about the people in power, they will dictate how your affairs are handled when you can no longer decide for yourself—unless you act now.

The good news? You don’t have to leave these critical decisions in the hands of strangers. You can take control today by putting your wishes into legally effective documents. That’s where we come in.

📞 Call (918) 981-2095 or 📩 email [email protected] now to schedule a consultation and take back control of your future.

In a world where so much feels uncertain, your family, your property, and your final wishes should not be left to chance.

🔍 What Is a Trust (and Why Might You Want One)? 🔍

A trust is a legal tool that lets you control how your assets are managed and passed down—without going through probate.

Think of it like a box 📦 where you place your assets while you’re alive. You decide:
✔ Who manages the box (the trustee)
✔ Who benefits from it (you, your family, charities, etc.)
✔ What happens to everything in it when you’re gone

💡 Why do people use trusts?
✔ Avoid probate (saves time and money)
✔ Keep things private (wills go through court, trusts don’t)
✔ Protect assets (for kids, spouses, or loved ones)
✔ Plan for incapacity (trusts can help if you ever can’t manage finances)

Not everyone needs a trust, but for many, it’s a game-changer. Curious if it’s right for you? Let’s chat!

Free will. Would You Be Interested? 🤔💙

We’re considering an idea for a special promotion: a free will—with just one small condition. It would have to include a gift of any size to a charity of your choice.

This could be a great way to take care of your own planning while also giving back to a cause you care about.

Would something along these lines interest you or someone you know? Please let us know what you think!
