Does infidelity actually impact the outcome of your divorce?

While discovering an affair can be devastating, infidelity doesn't automatically influence how assets are divided or who receives custody.

In Georgia, the circumstances matter. Certain situations involving infidelity can have legal implications, particularly when marital assets or children's well-being are involved.

The bottom line? Not everything that's emotionally significant is legally relevant.

🎙️ Founding Partner Sara Khaki and Managing Partner Shawna Woods break down this distinction in an episode of the Happily Ever After Divorce™ Podcast: Just Bad Behavior or Legally Relevant Evidence?

Silence in a marriage isn't always peace.
In this clip from The Happily Ever After Divorce® Podcast, Attorneys Sara Khaki and Shawna Woods talk about "quietly quitting" a marriage. The slow, often invisible withdrawal that can leave one spouse blindsided when divorce papers finally arrive.
In most cases, the people who quietly quit weren't always checked out. Many fought hard for an outcome first, investing emotional labor, and only pulled back once they stopped believing anything would change. That's what makes it so hard to spot, and painful when it surfaces.
The full episode goes further into why "healthy friction" in a relationship is often a sign of investment, not dysfunction. It also covers how gender, power, and who earns what shape whose withdrawal gets noticed.

Not all court orders protect you the same way.
A standing order goes into effect automatically once a divorce is filed. It keeps finances and parenting arrangements steady, but it isn’t built for emergency safety.
A protective order (TPO) is different. It’s filed separately in Superior Court, and it can include no-contact, stay-away, and temporary custody terms.
If safety is a concern, know the difference, and know that help is available.

Leaving abusive relationships requires strategic safety planning.
In this clip from our Leaving Abusive Relationships webinar, Senior Attorney Jim Powers walks through what to put in place first:

1️⃣ Know where you can go that's safe
2️⃣ Gather documents that are hard to replace, like birth certificates, passports, and Social Security cards
3️⃣ Secure your finances and passwords, and remove any recovery emails your partner can access

This Domestic Violence Awareness Month, we want you to know you don't have to figure this out alone. If you're ready to talk through your options, our team is here.

This post is for general information only and isn't legal advice. Every situation is different, so please speak with an attorney about yours.

If you are in immediate danger, call 911. For confidential support 24/7, contact the National Domestic Violence Hotline at 1-800-799-7233 or text START to 88788.

Your marital balance sheet shows what you have. It doesn't show how it has to be divided.
In Georgia, marital property is divided equitably, which isn't always equally. That gives you room to negotiate trades, but how more complex assets will be divided isn't always easy to forecast.

From certain pensions and retirement plans that can't be transferred to stock options and foreign property, these gray areas are where things get complicated.

The key to a realistic financial forecast isn't splitting every account in half. It's a strategic, flexible settlement. By trading asset classes (like cash for retirement accounts), you can build a plan that actually works for your future.

A prenup isn't the only way to protect what matters to you.
If you didn't sign one before the wedding, a postnuptial agreement can do much of the same work, clarifying finances, protecting assets, and setting expectations, no matter how long you've been married.
It's never too late to get clarity.
Save this for when you need it.

Does hiring a divorce attorney mean you’re officially getting divorced?
Not necessarily.
In this episode of the Happily Ever After Divorce® Podcast, Sara Khaki and Shawna Woods clear up what it actually means to “retain” an attorney, why getting legal guidance doesn’t mean you have to file before you’re ready, and how preparing early can help you better understand your rights, options, and next steps without automatically turning an amicable situation into a costly legal battle.
Because sometimes, talking to an attorney isn’t about starting a divorce. It’s about having the information you need to decide what comes next.

No formula, calculator, or magic percentage decides spousal support. Swipe through to see what factors weigh in on alimony in Georgia.

On this episode of The Happily Ever After Divorce® Podcast, Attorneys Sara Khaki and Shawna Woods cover the factors judges weigh, monthly support vs. lump sum settlements, why the ‘one third of the marriage’ rule doesn’t hold up, and what changes once retirement is on the table.

If you’re waiting on a set percentage or a “rule of thumb” to tell you what alimony will look like, here is your reality check.

In this clip from The Happily Ever After Divorce® Podcast, Attorneys Sara Khaki and Shawna Woods unpack why there’s no statute, no formula, and no guaranteed outcome for spousal support. Instead, a judge weighs a list of factors to decide whether to award alimony, and for how long and how much.
The full episode goes further, tackling myths around income disparity and why you should never put financial independence on hold while you wait for a legal outcome.
