Today, we celebrate Carolina Day! 250 years ago on June 28, 1776, just six days before the signing of the Declaration of Independence, South Carolina patriots led by Colonel William Moultrie held Fort Sullivan against the British fleet – and won. The fort’s palmetto-log walls absorbed all the cannon fire sparing Charleston from occupation. The British turned back and that victory inspired the palmetto tree that has been on our state flag ever since.

On March 19, 2026, the U.S. District Court for the Eastern District of Texas issued a decision in Flowers Title Companies, LLC v. Bessent vacating the FinCEN Anti-Money Laundering Regulations for Residential Real Estate Transfers Rule ("Rule"). Effective immediately, the Rule is vacated and no longer in effect. FinCEN’s website has been updated with an alert stating, “[i]n light of a federal court decision, reporting persons are not currently required to file real estate reports with FinCEN and are not subject to liability if they fail to do so while the order remains in force.”

Starting March 1, 2026, the Financial Crimes Enforcement Network (FinCEN), part of the U.S. Department of the Treasury, began requiring certain professionals involved in residential real estate closings—including attorneys—to report certain transactions. In general, this rule applies to home purchases made without a traditional bank loan, such as all-cash deals and where the buyer is a company or legal entity, like an LLC, corporation, or trust, although some transactions may be exempt.
