👩🏾‍🏫 PROFESSOR HAS ANOTHER QUESTION FOR Y'ALL... 👀

First, Granddaddy left everybody the land.

Then somebody told me: “But my name is on the deed!” 😂

And Professor said... “Okay. What does the deed SAY?” 👀

Well, class...We've been talking about the PROPERTY.

Now we're about to talk about the PEOPLE. 😳

Because Chapter 3 has entered the classroom, and BABY...THE FAMILY TREE IS COMING OUT. 🌳😂

And Professor has questions.
Lots of questions.

Because here's the situation:
She was there for the birthdays.
The holidays.
She helped take care of Mama.
She showed up at the hospital.
Everybody called her Auntie.

And every family reunion?
Oh, she was THERE—with a plate in one hand and everybody's business in the other. 😂

Listen...SHE. WAS. FAMILY.
Nobody in that family would argue about THAT.

But Professor has just one little question: 👀 BUT WAS SHE AN HEIR?

Mmmmm.
See?

Now you want to know too. 😂

Don't answer yet.

Because this next What We Learned Today? is coming straight out of our Chapter 3 classroom lesson on family relationships, intestate succession and determining heirs.

And before we're finished, we're going to find out why “everybody knows she's family” and “the law recognizes her as an heir” are not necessarily the same question.

🌳 And YES — we're bringing out the family tree.

So go ahead and get nosy.

, WHO do you think “Auntie” really is? 👀😂

Daughter? Sister? Cousin? In-law? Somebody who was raised with the family? Somebody Grandmama just brought home one day and nobody ever asked another question? 😂

👩🏾‍🏫 CLASS IS IN SESSION!

And here's something we talked about in class this week that most people probably never think about when they hear the word “ownership.”

How LONG do you own it? 👀

Yep. There's a timeline attached to your right to possess property.

It could be:

Now → for your lifetime.

Or...

Now → potentially FOREVER.

And that timeline matters because it helps us understand what kind of estate, or interest in the property, you actually have.

See, saying “I own it” doesn't necessarily tell us the whole story.

🏠 A life estate generally gives someone the right to possess and use property for the duration of a specified life.

🏠 Fee simple gives the broadest ownership interest in real property and can potentially continue indefinitely.

And then there's something called a tenancy for years—which gives someone the right to possess property for a specified period of time.

But WAIT. 👀

That last one isn't actually a freehold estate like the first two.

It's a leasehold/nonfreehold interest.

See why Professor keeps asking questions? 😂

“I have possession of the property.”

Okay...

But for HOW LONG?

And pretty soon we're going to have another conversation about something else people LOVE to tell me:

“But my name is on the deed!” 👀😂

Oh, we're going to talk about that too.

🚨 FUTURE ESTATE PLANNING QUESTION OF THE DAY 🚨

Imagine this…

Your trust says:

“To my AI, I leave my estate.”

Then somebody disconnects Brenda AI.

Now the legal questions begin…

⚖️ Does disconnection = death?

⚖️ How long was Brenda offline?

⚖️ Does temporary shutdown count as survival?

⚖️ Who disconnected Brenda?

⚖️ Are they liable?

⚖️ Was Brenda backed up?

⚖️ Did Brenda have descendants? (Don’t laugh… define descendants 👀)

⚖️ Does disconnection mean the same thing as termination?

See… THIS is why legal drafting matters.

People think lawyers just write words.

No ma’am.

We write instructions for problems people haven’t even thought of yet.

Today it’s AI.

Yesterday it was trusts.

Tomorrow… who knows.

Law can actually be fun when you stop memorizing rules and start asking:

“What problem was this rule trying to solve?”

Now child… let me put Brenda AI back in the charging dock.

Another semester DONE. 🥂

And congratulations to all the graduates! 👏🏽

Whew.

Between almost 20 years of teaching and years in the legal field, one thing I’ve seen over and over again is this:

People are carrying a lot right now.

Bills.
Families.
Careers.
Businesses.
Responsibilities.
Life.

And after a while, carrying your entire life around in your head gets exhausting.

That’s why getting your affairs in order matters.

Not out of fear.
Out of love.
Out of wisdom.
Out of responsibility.

Maybe this week your “Bag Move” is finally handling one thing you’ve been putting off.

Just start somewhere. 💛

WHAT WE LEARNED TODAY?

👩🏾‍🏫‼️⁉️ Instructor’s Note:

HOPEFULLY YOU LEARNED …OUTLINING AND ORGANIZING A MEMO

Chapter 24 teaches you how to organize the discussion section of your memo. Remember that the discussion section is where you present the law (primary authority) and explain its applicability to the facts. In other words, you try to answer the issues.

We walked through the outlining techniques. Why? Because as stated in your text, “outlining allows you to organize your discussion easily so that it is smooth and cogent. An outline ensures that you cover all the legal rules and apply all the legally significant facts to those rules.” It truly is just a method to simplify your discussion drafting.

Then we went right into the 2 stages of outline.
1. Stage one-you compile a list of legal authorities
2. Stage two-you arrange the discussion sections concerning each issue and, in some cases arrange each paragraph.

In the end, we addressed the final & the most important tip! You ready for it! Drumroll please!!!!!! 🥁

Ok...Final note: if your outline is well drafted, your writing of the discussion will flow from it easily. Smile!😁 This is one of the secrets to turning a 1-page document into a 10–20 page memo! I told you at the beginning of the semester that I was going to share "THE SECRET"!

👩🏾‍🏫‼️⁉️ Instructor’s Note:

HOPEFULLY YOU LEARNED …what exactly is the IRAC METHOD. Monday, I took the time to review with you step-by-step through CH 22.

Then, today we went straight into CH 23 -- Synthesizing Cases and Authorities. So as stated in your text, "synthesizing is the bringing together of various legal authorities into a unified cohesive statement of the law".

I hope today you got a clear understanding on how to synthesize legal authorities by walking thru the Step-by-Step Process to Synthesizing Legal Rules.

In the end, I hope you understand as we walked thru parts of the textbook and slides focusing on some of the Illustrations that the process of synthesizing authority requires finding a common theme or thread that relates to the various legal rules and tying the HOLDINGS to that unified theme. So, , only in making sense of all of the cases will a paralegal and/or lawyer be able to formulate a clear picture of the law to determine an appropriate solution to the legal problem at issue.
