🚨 FUTURE ESTATE PLANNING QUESTION OF THE DAY 🚨

Imagine this…

Your trust says:

“To my AI, I leave my estate.”

Then somebody disconnects Brenda AI.

Now the legal questions begin…

⚖️ Does disconnection = death?

⚖️ How long was Brenda offline?

⚖️ Does temporary shutdown count as survival?

⚖️ Who disconnected Brenda?

⚖️ Are they liable?

⚖️ Was Brenda backed up?

⚖️ Did Brenda have descendants? (Don’t laugh… define descendants 👀)

⚖️ Does disconnection mean the same thing as termination?

See… THIS is why legal drafting matters.

People think lawyers just write words.

No ma’am.

We write instructions for problems people haven’t even thought of yet.

Today it’s AI.

Yesterday it was trusts.

Tomorrow… who knows.

Law can actually be fun when you stop memorizing rules and start asking:

“What problem was this rule trying to solve?”

Another semester DONE. 🥂

And congratulations to all the graduates! 👏🏽

Whew.

Between almost 20 years of teaching and years in the legal field, one thing I’ve seen over and over again is this:

People are carrying a lot right now.

Bills.
Families.
Careers.
Businesses.
Responsibilities.
Life.

And after a while, carrying your entire life around in your head gets exhausting.

That’s why getting your affairs in order matters.

Not out of fear.
Out of love.
Out of wisdom.
Out of responsibility.

Maybe this week your “Bag Move” is finally handling one thing you’ve been putting off.

Just start somewhere. 💛

HOPEFULLY YOU LEARNED …OUTLINING AND ORGANIZING A MEMO

Chapter 24 teaches you how to organize the discussion section of your memo. Remember that the discussion section is where you present the law (primary authority) and explain its applicability to the facts. In other words, you try to answer the issues.

We walked through the outlining techniques. Why? Because as stated in your text, “outlining allows you to organize your discussion easily so that it is smooth and cogent. An outline ensures that you cover all the legal rules and apply all the legally significant facts to those rules.” It truly is just a method to simplify your discussion drafting.

Then we went right into the 2 stages of outline.
1. Stage one-you compile a list of legal authorities
2. Stage two-you arrange the discussion sections concerning each issue and, in some cases arrange each paragraph.

In the end, we addressed the final & the most important tip! You ready for it! Drumroll please!!!!!! 🥁

Ok...Final note: if your outline is well drafted, your writing of the discussion will flow from it easily. Smile!😁 This is one of the secrets to turning a 1-page document into a 10–20 page memo! I told you at the beginning of the semester that I was going to share "THE SECRET"!

HOPEFULLY YOU LEARNED …what exactly is the IRAC METHOD. Monday, I took the time to review with you step-by-step through CH 22.

Then, today we went straight into CH 23 -- Synthesizing Cases and Authorities. So as stated in your text, "synthesizing is the bringing together of various legal authorities into a unified cohesive statement of the law".

I hope today you got a clear understanding on how to synthesize legal authorities by walking thru the Step-by-Step Process to Synthesizing Legal Rules.

In the end, I hope you understand as we walked thru parts of the textbook and slides focusing on some of the Illustrations that the process of synthesizing authority requires finding a common theme or thread that relates to the various legal rules and tying the HOLDINGS to that unified theme. So, , only in making sense of all of the cases will a paralegal and/or lawyer be able to formulate a clear picture of the law to determine an appropriate solution to the legal problem at issue.

HOPEFULLY YOU LEARNED …what exactly is a FACT STATEMENT. Today, I took the time to re-review with you step-by-step through CH 21. I hope today felt like a refresher as we walked thru parts of the textbook and slides focusing on some of the Illustrations.

, When it comes to the FACTS, you must lean in & choose descriptive words and incorporate a fair amount of detail when recounting facts. State the facts as specifically as possible to make them memorable.

Cover the 5Ws—Who, What, When, Where, Why w/vivid adjectives and actions verbs remember that’s active voice--- laced with clear and concise facts and imagery (make the reader see, hear, touch & feel).
