What's the law on employers firing employees over social media posts?

Private Employers: In Texas, most private employment is at-will. Therefore, the employer can terminate an employee for almost any reason, including a social media post. This can happen unless the firing violates a specific law -- for example, discrimination laws, whistleblower protections, or protected concerted activity. With regard to Kirk's assassination, there is likely no legal protections for comments (one way or another).

Public (Government) Employers: Public employees have relatively limited First Amendment protections. They may have some rights if the speech touches on a matter of public concern (fn.1) and outweighs the government’s interest in workplace efficiency. But posts that disrupt operations or violate workplace policies can still be grounds for discipline or termination.

Fn. 1: Pickering v. Board of Education, 391 U.S. 563 (1968) – Established the balancing test: a public employee’s right to speak on matters of public concern vs. the government’s interest in efficient operations. (In that case, a public school teacher wrote a letter to a local newspaper criticizing the school board’s allocation of funds between academics and athletics and was terminated.)

Our Story

I have dedicated my law practice to serving others. Whether you need help with an employment dispute, estate planning to give yourself and loved ones security, or other civil dispute I want to be the lawyer to help you.

A. Estate Planning:

My practice offers flexible hours and house calls, and flat-rate estate plans for qualified individuals.

I have represented clients in estate planning matters for years. I have helped families with special needs children plan for that child’s future. I have gone to the hospital and consulted with clients and their families about the law in the most difficult of times. And, I have represented LGBT couples and addressed needs that are specific to that community. Common areas in which I advise clients include:

- Last Will and Testament; - Power of attorney; - Medical power of attorney & HIPAA Release; - Advanced directive (living will); - Burial instructions; - Declaring a guardian; and - Trusts.

B. Employment Law:

I have practiced employment law for years. I have represented employees against Fortune 500 companies such as Southwest Airlines and Wal-Mart. I have battled against the Federal Government in EEO and MSPB matters, the State of Texas, and cities and school districts.

I have represented employees making minimum wage and those earning six-figures. I have represented a wide range of people from those with disabilities, to those whose employers did not pay them, and just about everything in between. For more information, go to my employment law landing page.

C. Civil Litigation

I have represented clients in both Federal and state court. These matters ranged from breach of contract claims, family law issues, deceptive trade practice claims, and of course, employment claims. I strategize with clients and advise them on their case and their options.

Education & Background:

Before opening my own practice, I worked at a prestigious Dallas-based labor and employment law firm. There, I handled scores of cases representing employees. At this law firm, I also represented the firm’s legacy estate planning clients. In May 2018, I returned to my native Houston to open my own practice.

I graduated from Southern Methodist University Dedman School of Law with honors, cm laude. I earned my B.A. in International Studies from Texas A&M University, graduating

summa cm laude. While at Texas A&M, I studied abroad in Salzburg, Austria where I perfected my German. During and after law school, I taught myself Spanish and Portuguese.

Continuing my education, I received the Deans Scholarship and attended the Southern Methodist University - Dedman School of Law. There, I studied employment law, employment discrimination, business entities, and estate planning among other subjects. While in law school, I made the dean's list and graduated with honors, cm laude.
