What's the law on employers firing employees over social media posts?

Private Employers: In Texas, most private employment is at-will. Therefore, the employer can terminate an employee for almost any reason, including a social media post. This can happen unless the firing violates a specific law -- for example, discrimination laws, whistleblower protections, or protected concerted activity. With regard to Kirk's assassination, there is likely no legal protections for comments (one way or another).

Public (Government) Employers: Public employees have relatively limited First Amendment protections. They may have some rights if the speech touches on a matter of public concern (fn.1) and outweighs the government’s interest in workplace efficiency. But posts that disrupt operations or violate workplace policies can still be grounds for discipline or termination.

Fn. 1: Pickering v. Board of Education, 391 U.S. 563 (1968) – Established the balancing test: a public employee’s right to speak on matters of public concern vs. the government’s interest in efficient operations. (In that case, a public school teacher wrote a letter to a local newspaper criticizing the school board’s allocation of funds between academics and athletics and was terminated.)
