🚨 Massive Shift in U.S. Immigration Policy Announced Today 🚨

USCIS just dropped a bombshell policy memo that attempts to fundamentally upend the Adjustment of Status (AOS) process.

According to the new directive, USCIS will effectively halt domestic Green Card processing for most temporary visa holders (such as H-1B workers and F-1 students), granting AOS only in vaguely defined “extraordinary circumstances.”
Instead, the agency expects applicants to return to their home countries and undergo consular processing via the Department of State.

While USCIS claims this returns to the “original intent of the law” and will increase efficiency, a closer look reveals severe legal and practical flaws:

Statutory Overreach: Congress explicitly codified the AOS process in Section 245(a) of the INA specifically so eligible, legal residents would not have to endure the hardship of leaving the country to get their Green Cards. This executive memo attempts to bypass that established law without formal legislative or administrative rulemaking.

Manufactured Hardship: Forcing integrated professionals and students to abandon their lives, jobs, and families for overseas processing creates a logistical and emotional nightmare.

The Efficiency Myth: Dumping tens of thousands of applications onto the Department of State will merely shift the bottleneck, exacerbating the already massive backlogs at U.S. embassies worldwide.

Because this memo so deeply contradicts the statutory language of the INA, it is highly vulnerable to federal lawsuits.
