I have signed up more "gray divorces" this year than I have any year prior.

It’s something a lot of us are wondering after reading the news about Nicole Kidman and Keith Urban.

I try to volunteer for these as often as I can. Was such a great day providing help to others. The most requested help was assistance in getting arrearages waived, some of which was actually being handled right on the spot.

Many thanks to the 17 attorneys who volunteered their time last Saturday to help approximately 65 individuals with their child support, custody and parenting time issues at our Child Support Help Program in Detroit. That event was free for local residents and was sponsored by the Salvation Army William Booth Legal Aid Clinic.

This topic is not discussed enough when the low income earner in a divorce is going to need the spousal support payments considered income to qualify for a new home. As Marc points out, you need a history of 6 months of payments for it to be considered.

How alimony is received plays a critical role in qualifying for a mortgage. It's important to note that alimony paid in advance cannot be counted toward the receipt requirement. Similarly, if alimony is paid semi-annually, it cannot be counted until six consecutive semi-annual payments have been received.

Why is this the case? The requirement to show six months of consistent receipt establishes the income's stability and reliability. This ensures that the alimony is ongoing and dependable, making it a credible source for mortgage qualification.

Understanding these nuances is critical for family law professionals, mediators, and divorce financial planners to guide clients effectively through settlement and negotiation. Properly documented and consistently received alimony payments can make a significant difference in securing the desired mortgage terms.

As a Certified Divorce Lending Professional (CDLP) I understand these nuances can make a significant difference in successfully navigating the mortgage process during or after divorce. Consult with me to ensure all financial factors are accounted for accurately.
