We’ve been having this conversation with clients more and more frequently, so we decided to create something that helps explain it.

In premises liability cases, health insurance companies may have a right to be reimbursed from a settlement for medical expenses they paid related to the injury. These are commonly called medical or health insurance liens.

For clients, this can sometimes be confusing, especially if they have previously been involved in a Michigan auto accident where PIP benefits paid the medical expenses and a health insurance lien was not an issue.

It can also be frustrating when a case has settled, but we are still waiting for a health insurer or lien administrator to provide a final lien amount or respond to our efforts to reduce it.

We work diligently to obtain, review, negotiate, and resolve these liens. Sometimes that means challenging unrelated charges. Sometimes it means negotiating for a reduction. And sometimes it means repeatedly following up with a health insurer while we wait for information that only they can provide.

So, we created this guide to explain the process in simple terms: why medical liens exist, why they can sometimes delay settlement distribution, what we do to resolve them, and why taking the time to negotiate them can ultimately mean more of the settlement goes to our client.
