Negotiation & Mediation — Avoiding Trial

Will I have to go to court?

In many cases — no.

A large number of divorce and custody cases are resolved through negotiation or mediation, rather than going to trial.

This process allows both sides to:
• Discuss solutions outside of the courtroom
• Maintain more control over the outcome
• Reduce time, stress, and cost
• Create more flexible, personalized agreements

For families — especially those with children — this can be a more constructive path forward.

That said, not every case can (or should) be settled. Having an attorney who is prepared for both negotiation and litigation is key.

Information Gathering — What You’ll Need

“What documents do I need for my divorce or custody case?”

This is a question almost everyone asks — and for good reason.

Once a case begins, both sides are required to exchange information. This step is called discovery, and it’s all about transparency.

You may be asked to provide:
• Income information (pay stubs, tax returns)
• Bank and retirement account statements
• Property and debt details
• Work schedules and childcare arrangements

It can feel overwhelming — especially if you’re already dealing with emotional stress.

But this step is critical. Having complete and accurate information helps ensure fair outcomes when it comes to support, custody, and property division.

The good news? You don’t have to organize it all alone.

Temporary Orders — What Happens Right Away?

What happens immediately after a divorce or custody case is filed?

This is one of the biggest sources of anxiety — especially when children, finances, and living arrangements are involved.

In many cases, the court will enter temporary orders early in the process. These are short-term decisions that create stability while your case is ongoing.

They may address:
• Parenting time (who the children are with and when)
• Child support or spousal support
• Who stays in the marital home
• Payment of bills and expenses

These orders are not permanent — but they can shape what your day-to-day life looks like for months.

That’s why it’s so important to approach this stage thoughtfully and with the right guidance.

You don’t have to guess your way through this.

What to Expect in a Divorce or Custody Case

If you’re thinking about divorce or dealing with a custody issue, you’re probably feeling overwhelmed — and unsure of what comes next.

You’re not alone. One of the most common questions I hear is: “What does the process actually look like?”

Here’s a simple breakdown:
• Step 1: Filing – One party files a complaint to start the case• Step 2: Temporary Orders – The court may set short-term rules for parenting time, support, or living arrangements• Step 3: Information Gathering – Both sides exchange financial and other important information• Step 4: Negotiation or Mediation – Many cases resolve here without trial• Step 5: Trial (if needed) – If no agreement is reached, a judge makes the final decisions

Every case is different — but having a clear understanding of the process can make it feel far less intimidating.

This is the first post in a series where I’ll walk you through family law topics step by step, so you can feel informed and prepared.

You don’t have to navigate this alone.
