Equitable Distribution Isn't Equal

One of the most common misconceptions in divorce: that marital assets always split 50/50. In New York, they don't.

New York is an "equitable distribution" state — and "equitable" means fair, not equal. Courts weigh many factors to decide what each spouse should walk away with.

What courts consider:

⚖️ The length of the marriage
⚖️ The age and health of each spouse
⚖️ Each spouse's income and property
⚖️ Each spouse's contribution to acquiring marital property — including non-financial contributions like homemaking and child-rearing
⚖️ The need of the custodial parent to keep the marital home
⚖️ The tax consequences of each proposed division
⚖️ Any wasteful dissipation of assets by either spouse

Can You Modify Child Support in New York? The Three Legal Grounds

Life changes. Income changes. Children's needs change. The child support order you agreed to five years ago may no longer reflect reality — and New York law recognizes that.

Under New York law, you can request a modification of child support if ANY of these three grounds apply:

1️⃣ Three years have passed since the order was issued or last modified
This is the simplest path. After three years, either parent can request a review.

2️⃣ Either parent's income has changed by 15% or more
Whether the change is up or down, a 15% income shift opens the door to modification.

3️⃣ A substantial change in circumstances
This can include job loss, serious illness, a new child, a significant change in the child's needs, or other major life events.

Important: Child support does not modify automatically. You must file a petition. Until the court enters a new order, you're legally obligated to pay the existing amount.

If your circumstances have changed, don't wait. Modifications generally are not retroactive before the date of filing.
