The Pennsylvania Superior Court recently issued a decision that affirmed prior PA law that generally gives a sentencing judge the discretion or ability to give credit for time spent at an inpatient treatment facility. Experienced criminal defense attorneys can often advise clients as to whether or not a judge will give credit. Experience matters.

More and more people are acting as vigilantes and taking the law into their own hands under the excuse that they are defending their children and loved ones after being verbally harassed. I concede that I should not "judge a man until you walk a mile in his shoes," but I take apply that adage and understand that I don't know what I would do if I were in that position. However, that doesn't make what happened correct. This case involves an off-duty cop chasing and running people off the road. After the accident, witnesses claim that the officer stated that the people got what they deserved for messing with his kid, so no expression of remorse for his actions. I readily admit that I have done stupid things when I have lost my temper, but I have been remorseful after the fact. Lately, I see situations like this in which the person never expresses remorse but instead thinks that their actions were justified.

Drug possession requires proof or evidence that the person knew about the drugs. This woman claims that she didn't know that the co***ne was in her bum. Probably not a very viable or believable defense. If you were on the jury, would you believe that a person didn't know that they had a few grams of co***ne in their butt?

But I do question whether she should be charged with taking the drugs into the jail, which in PA would be called Contraband. She obviously didn't volunteer to go to jail. She was forced to go. I would argue that she has a 5th Amendment right to remain silent and not tell the police about the drugs. The only way to avoid the Contraband charge would be to admit to drug possession.

The PA Officer of Attorney General has created a list of states that honor a AP Concealed Carry Permit. Regrettably, people that have a PA Permit can be charged with violating state firearm possession laws in states that do not grant reciprocal treatment for PA's permits.

The Pennsylvania Superior Court issued a decision reiterating that the police must obtain a warrant before conducting a search, and using a flashlight to look into a shoebox constituted a search. When cops take shortcuts and don't get a warrant, the courts must follow constitutional mandates and grant the suppression of evidence.

A PA Court ruled that police conducted a warrantless search by using a flashlight to look into a shoebox, so Court suppressed drug evidence.
