What Happens to an Inheritance During Divorce?

“My parents left the money to me, so my spouse can't touch it.”

Not necessarily that simple. Applying CT or NY law is vastly different in this area. How an inheritance is treated in a divorce can depend on the circumstances, including how the inheritance was received, maintained, used, or combined with other marital finances.

For example, there can be a difference between:

-Keeping inherited funds separately and maintaining clear records

&

-Depositing inherited funds into a joint account or using them toward marital expenses or property.

Documentation and financial history can matter. If you received an inheritance during your marriage or entered your marriage with inherited assets, let’s talk.

What Happens to a Family Business in a Divorce?

A family business can be one of the most valuable & complicated assets involved in a divorce.

Like a house, businesses cannot be cut in half. Depending on the circumstances, important questions may include:

• Was the business started before or during the marriage?
• Who owns the business and how is it structured?
• Did either spouse contribute to the business?
• What is the business actually worth?
• Does the business generate income for either spouse?
• Could one spouse buy out the other's interest?

Business interests may require a careful valuation and review of financial records, ownership interests, and income before the parties can determine how the business should be addressed.

If a family business is part of your financial picture, understanding your rights and options early can make a difference. Let’s talk.

What Happens to a Joint Bank Account After Separation?

When a couple separates, a joint bank account can quickly become a source of concern. Separating does not necessarily mean the account is divided equally.

The source of the funds, contributions made by each spouse, and how the account was used may all be relevant when addressing finances during a divorce.

Before transferring, withdrawing, or closing funds, it is important to understand how those actions could affect your case. Let’s talk.

The Debt Is in My Spouse's Name. Could It Still Affect Me?

Possibly.

Just because a debt is in one spouse’s name doesn't necessarily mean it can be ignored during a divorce.

Factors such as when the debt was incurred, what it was used for, and whether it relates to marital expenses may matter.

And remember; who owes the creditor and how the debt is divided between spouses in a divorce are two different questions.

Divorce isn't just about dividing assets. Understanding the liabilities is just as important. Let’s talk.

Your Children Shouldn’t Have to Choose Sides.

Divorce and separation can be difficult for everyone, but children should not be placed in the middle.

Avoid:

• Asking children to carry messages between parents
• Discussing litigation or finances with them
• Asking them to choose sides
• Using parenting time as leverage
• Speaking negatively about the other parent in front of them

You may be going through a legal dispute. Your child shouldn't have to go through it with you. Let’s talk.

Prenup Or Will? Why Not Both?

A Prenuptial Agreement and a Will serve different purposes and one does not replace the other.

A Prenup generally addresses financial rights and obligations between spouses, in the event of divorce or separation.

A Will addresses how certain assets should be distributed after death and can address important issues involving children and your estate.

For some couples, coordinating these documents can be an important part of planning their future together. Getting married? Don’t just plan the wedding. Plan for your legal and financial future, too. Let’s talk.

Opening a separate bank account during a divorce doesn’t automatically make money “yours.” Financial issues in divorce can be complicated, and moving or hiding assets can create serious problems.

During a divorce, financial issues can involve questions about marital versus separate property, when money was earned or acquired, and whether assets have been commingled.

Keep in mind:

• Opening a new account does not automatically make it yours.
• Moving money between accounts does not necessarily make it separate property.
• Hiding, transferring, or intentionally dissipating marital assets can create legal and financial consequences.
• Financial records, including bank statements and account histories, may be important in determining what happened to marital funds.

If you’re considering separating your finances during a divorce, get legal advice before moving significant amounts of money or changing how assets are held. Let’s talk.

When parents separate or divorce, grandparents can sometimes find themselves caught in the middle.

Grandparents may have questions about:

• Visitation or parenting time with grandchildren
• Whether they can seek custody or guardianship
• What happens if a parent refuses to allow contact
• How an existing custody order affects grandparent contact
• Whether they have legal standing to ask a court for visitation

Grandparents’ rights vary from state to state, and courts may consider factors such as the child’s best interests and the nature of the grandparent-child relationship.

If you’re a grandparent facing limited or denied contact with your grandchildren, don’t assume you have no options, let’s talk.

Is a formal parenting agreement necessary?

Reaching an agreement with the other parent can make a family law matter less stressful but an agreement is only as helpful as the details it addresses.

Before signing or submitting an agreement, make sure you understand what you are agreeing to.
And remember: a verbal agreement, text message, or handshake may not provide the same protection as a properly drafted and court-approved agreement or order.

If you have reached an agreement, take the time to understand your rights, obligations, and what happens if the other parent does not follow the agreement. Let’s talk.
