Myth: child support stops the day my child turns 18.

Fact: in Virginia, support generally runs to 18, and it keeps going for a child who is still a full time high school student, not self supporting, and living with the parent receiving support, until graduation or age 19, whichever comes first. A court can also continue support for an adult child with a severe and permanent disability that began before support would have ended.

Health insurance open enrollment starts at most employers this month, and your choices may affect child support.

Your order likely says which parent carries the children on a health insurance plan and how the premium and unreimbursed medical costs are divided. Read it before making an election you cannot change until next year, and tell your co-parent what you plan to change.

You do not need to have every detail of a divorce or custody case worked out before your first meeting.

Many people meet with us to understand where they stand and leave without filing anything. A first consultation gives you up to an hour with an attorney, and you leave with a clearer understanding of your options and what each one would involve.

When you remarry, you should update your estate plan.

Virginia law cancels the parts of a will that favor a former spouse once a divorce is final. However, the law does not add your new spouse or protect children from a first marriage. Beneficiary forms for employer retirement plans require separate attention because, under federal law, many benefits are paid to whoever is named on the form, regardless of what your will says.

We update wills, directives, and beneficiary designations as part of our estate planning practice so your documents reflect your current family.

If you or your spouse served in the military, the military pension may be one of the largest assets in your divorce.

Our guide to military retirement in a Virginia divorce includes a pension calculator. Enter the service dates and marriage dates to see a rough estimate of the marital share. The result is an estimate and not legal advice, but it can give you a useful starting number.
