With Fireworks Safety Month in June and July 4th the week after, now is the perfect time to review how liability can impact negligence claims after fireworks-related injuries.

Key liability considerations include:

🔷 Duty of care - Individuals using fireworks are generally expected to take reasonable steps to prevent foreseeable harm.
🔷 Negligence risks - Failing to maintain safe distances, supervise minors, or follow manufacturer instructions may increase liability exposure.
🔷 Premises liability - Property owners or event hosts may face claims if unsafe conditions contribute to injuries.
🔷 Regulatory compliance - Violating local ordinances or restrictions may strengthen negligence claims.
🔷 Insurance implications - Coverage varies by policy, and illegal or reckless use may affect claim outcomes.

Understanding liability before celebrations begin can help reduce legal risk, but it cannot eliminate them outright.

If you or someone you know is injured in a fireworks display, do not hesitate to reach out if you have questions about next steps after an incident. We are always here to help.

Juneteenth commemorates June 19, 1865, when federal troops arrived in Galveston, Texas, two years after the Emancipation Proclamation, to enforce Abraham Lincoln’s order to end slavery in the rebelling state farthest west

It’s been observed as a day to honor this history and celebrate Black culture and resilience, and it officially became a federal holiday in 2021.

In observance of the holiday, our office will be closed on June 19th. We’ll be back on Monday, June 22nd. We hope you have a meaningful and joyful Juneteenth!

Regardless of whether you are attending a fireworks show or planning to put on a small display of your own, it is important to remember that fireworks can cause serious injuries if not used with caution. A couple of common types of fireworks-related injuries include:

🔹 Burn injuries account for 37% of fireworks injuries and often affect hands, arms, and exposed skin. Even sparklers burn at extremely high temperatures and can cause serious burns.

🔹 Eye injuries can involve permanent vision impairment when safe viewing distances are not maintained.

🔹 Lacerations, hearing loss, and respiratory irritation can occur when devices malfunction, explode unpredictably, or produce excessive smoke or noise exposure.

🔹 More severe injuries from fireworks typically involve aerial shells or mortars from fireworks and may lead to long-term disability.

While being aware of these injuries is key to preventing them, it cannot prevent them outright. Having dedicated legal support is key in the event of an injury.

Reach out if you have questions about legal next steps after an incident. We are always here to help.
