St. Louis, MO - September 28, 2026 - Today, in the 8-Count lawsuit filed by Wake Up Jeffco LLC and four local residents in St. Louis County challenging the Data Center in Festus, Missouri, the judge DENIED the motion filed by the Data Center developer asking the Court to rule in its favor and toss out multiple Counts in the lawsuit. While the Court noted a procedural issue with two of Wake Up Jeffco's Counts, the judge gave Wake Up Jeffco a seven-day period to file an amended lawsuit to address the issue. As a result, all Counts in the lawsuit proceed ahead.

This follows a similar ruling a few days ago by the Court in a similar case brought in Cole County by Preserve Montgomery County LLC against Montgomery County challenging the Amazon Data Center project.

Victory in Montgomery County Data Center Case

Sept. 18, 2026 - Today, Judge Walker denied Montgomery County's request to dismiss the lawsuit filed by Preserve Montgomery County LLC challenging the Amazon data center project. The Judge also granted PMC's motion to compel and ordered the County to turn over e-mails and other documents relating to the data center that the County had refused to disclose to PMC. Finally, the Court granted a motion by the Missouri Department of Economic Development asking to be dropped from the case. Going forward, the County must produce documents to PMC within 20 days and the DED is no longer a party to the case. PMC moves forward in the lawsuit to shut down the data center.
