The portal has been open for a week and we're already seeing the same errors from last year:

Registration opens TODAY. Here's what to expect.

Starting today, the USCIS registration portal is open for 15 days (through March 19).

What happens:
1️⃣ You submit online registrations for each employee
2️⃣ Each registration is entered into wage-weighted lottery
3️⃣ Selections announced by late March/early April
4️⃣ If selected, you have 90 days to file the full H-1B petition

This year's change: Higher wage offerings get more weight in the lottery. If you're offering Level III or IV wages for specialized roles, your odds just improved significantly.

Not all jobs qualify for H-1B. Here's what actually works.

H-1B is for specialty occupations—jobs requiring at least a bachelor's degree in a specific field.

✅ Strong candidates:
• Software Engineer (CS, Software Engineering degree)
• Data Scientist (Statistics, Math, CS)
• Biostatistician (Statistics, Biostatistics, Epidemiology)
• Machine Learning Engineer (CS, AI, Engineering)
• Electrical/Mechanical Engineer (Engineering degrees)

⚠️ Harder cases:
• "Business Analyst" with mixed duties
• Generic "Consultant" roles
• Positions where degree field isn't clearly required

The FY2027 modernization rules place more emphasis on proving the specialty occupation requirement. If you're sponsoring someone, their job title, duties, and required degree need to align clearly.

20 years of immigration law taught me this: H-1B denials usually start at registration, not filing.

Most employers think the H-1B petition filing is where things can go wrong. But under the new rules, problems often begin weeks earlier—during the 15-day registration window.

Here's why:

The registration requires you to lock in:
• Your SOC code (occupational classification)
• Wage level (I, II, III, or IV)
• Work location

These details must later align exactly with your Labor Condition Application and H-1B petition. Mismatches lead to denials or revocations.

I've seen companies:
→ Select the wrong SOC code and can't file the petition they wanted
→ Claim a wage level they can't actually certify on the LCA
→ List a location that doesn't match where the employee will actually work

The fix? Treat registration like the legal commitment it is. Work backwards from the petition you'll file, not forward from a quick online form.

The H-1B lottery just changed. Higher wages now mean higher odds.

Starting March 4, employers registering for H-1B visas will compete in a wage-weighted lottery for the first time. Companies offering Level III or IV wages for specialized roles—software engineers, data scientists, biostatisticians—now have materially better selection odds than those offering entry-level wages.

What this means for your hiring strategy:
→ That machine learning engineer or biostatistician role? If you can offer a competitive wage, your chances just improved significantly.
