The New York Times reported that Justice Elena Kagan declined to intervene in a high-profile custody dispute, leaving in place a lower-court ruling recognizing Baby Rumi’s parents, represented by [Peiffer Wolf Carr Kane Conway & Wise's] Adam Wolf, as his legal parents.

Baby Rumi, who was born with a serious heart condition, has undergone open-heart surgery and remains hospitalized in Dallas, where his parents are staying with him.

Adam Wolf: "We are grateful that Rumi can continue receiving the treatment he needs to survive, and that he will not be stripped away from his parents, who are ensuring their child receives top-notch medical care. Ms. West’s legal filings across three states, numerous courts of appeals, and now the U.S. Supreme Court have sought to undermine Rumi’s parents’ right to provide him with the care he needs. Those efforts have been rejected by every single court."

A surrogate refused to have an abortion after the fetus was diagnosed with a serious heart problem. She asked the justices to block a court order giving custody to the biological parents.

In a significant win for our clients, the U.S. Supreme Court declined to intervene in a custody dispute involving their newborn son, allowing a California court order recognizing them as the child’s parents to remain in effect. The decision followed an emergency request by surrogate McKenna West, who sought conservatorship after refusing the couple’s requests over the child’s medical care.

Peiffer Wolf Partner Adam Wolf, who successfully argued the case before the Supreme Court, said the couple was “truly grateful” that their son could continue receiving the treatment he needs from his parents.

As reported by the Associated Press, the newborn, who has a life-threatening heart condition, underwent surgery shortly after birth.

On September 18, 2026, attorneys for Baby Rumi’s parents, including Peiffer Wolf Partner Adam Wolf, filed a response with the U.S. Supreme Court opposing the surrogate's bid to strip the child, who has an incurable heart condition, from the parents. This is the latest chapter in the custody dispute that has unfolded across courts in Alaska, California and Texas. Every legal proceeding to date has confirmed that Rumi’s parents are his legal and rightful guardians. The parents’ new filing responds to McKenna West’s September 9 emergency petition to challenge the parentage ruling in California.

Rumi was diagnosed before birth with hypoplastic left heart syndrome (HLHS), a severe congenital heart condition requiring intensive medical treatment and potentially multiple surgeries, and his parents say they remain committed to obtaining all available care for him.
