A child or other family member may spend substantial personal funds on a parent's mortgage, utilities, repairs, funeral expenses, or property preservation. Reimbursement may be appropriate, but it should not be treated as an informal withdrawal from the estate account.

Keep invoices, receipts, proof of payment, mileage records, and a clear explanation of why each expense benefited the estate. Creditor claims and limited estate assets can affect when reimbursement should occur.

When one spouse enters a nursing home and the other remains at home, the residence is generally protected for Medicaid eligibility purposes. But that does not answer every question.

Families must still consider ownership, later sale of the home, the spouse's death, liens, estate recovery, taxes, and what happens if both spouses eventually need care.

The correct process depends on title, the will, court authority, creditor issues, and whether the estate is supervised or independently administered. Signing a listing agreement or sales contract before the proper person has authority can delay or jeopardize the transaction.

Depending on the person's assets, authority under a power of attorney, transfer history, and timing, lawful strategies may preserve part of the estate while establishing eligibility. These cases require careful coordination because a transfer penalty begins only when the applicant is otherwise eligible.

Claims, expenses of administration, taxes, secured debts, family reimbursements, and beneficiary distributions do not all have the same priority. Selling a home may provide cash, but it does not eliminate the need to follow the required process.

The Medicaid five year lookback is often misunderstood. It is the period reviewed for certain transfers. It does not mean every applicant must wait five years, and it does not mean every transfer creates the same penalty.

The amount transferred, when it was transferred, who received it, and whether an exception applies can change the result.

The 2026 federal estate tax exclusion is $15 million per person, but Illinois families must also consider Illinois estate tax.

An Illinois estate with a gross value exceeding $4 million after adjusted taxable gifts may be required to file an Illinois estate tax return, even when no federal estate tax return is required. Farms, businesses, retirement accounts, life insurance, and appreciating real estate can push a family above that level faster than expected.
