When an estate has limited cash and several creditors, paying the loudest creditor first can create problems for the person administering the estate.

Claims, expenses of administration, taxes, secured debts, family reimbursements, and beneficiary distributions do not all have the same priority. Selling a home may provide cash, but it does not eliminate the need to follow the required process.

The Medicaid five year lookback is often misunderstood. It is the period reviewed for certain transfers. It does not mean every applicant must wait five years, and it does not mean every transfer creates the same penalty.

The amount transferred, when it was transferred, who received it, and whether an exception applies can change the result.

The 2026 federal estate tax exclusion is $15 million per person, but Illinois families must also consider Illinois estate tax.

An Illinois estate with a gross value exceeding $4 million after adjusted taxable gifts may be required to file an Illinois estate tax return, even when no federal estate tax return is required. Farms, businesses, retirement accounts, life insurance, and appreciating real estate can push a family above that level faster than expected.

A basic financial power of attorney may allow someone to pay bills, but it may not contain the specific authority needed for long term care asset protection, trust planning, real estate transactions, or Medicaid strategies.

The question is not merely whether you have a power of attorney. The question is whether it gives your chosen agent the powers your family may actually need.

Being named as the person responsible for an estate does not necessarily allow you to access accounts, sell property, or sign documents immediately after death.

In Missouri, the court appoints a Personal Representative. In Illinois, the court may appoint an Executor or Administrator. Until the proper authority is established, financial institutions and title companies may refuse to act.

Retirement accounts, life insurance, payable on death accounts, and transfer on death registrations generally pass according to the designation on the account, not the instructions in a will.

That can create an unexpected result when an old designation names a former spouse, a deceased beneficiary, or one child when the estate plan was intended to treat all children equally.

Farm families are sometimes told that farmland or other income producing property is exempt for Medicaid eligibility. That does not always mean the property is protected from liens, estate recovery, lost income, or an eventual forced sale.

Eligibility is only the first question. A complete plan also considers ownership, income, taxes, succession, and what happens after the Medicaid recipient dies.

A photocopy of a will may show what someone intended, but the original document can be critical when an estate must be opened.

Before assuming there is no will, check the person's home, safe deposit box, fireproof cabinet, and the office of the attorney who prepared the plan. Also determine whether a later will, trust, beneficiary designation, or deed changed the result.

In the St. Charles and St. Louis region, nursing home care can cost approximately $9,000 to $12,000 per month. At that rate, a family can lose $100,000 or more in a year while trying to understand Medicaid rules.

The important question is not simply whether Medicaid may eventually pay. It is what can lawfully be preserved before the family's options narrow.
