NOT GUILTY!
Today a client of Ozarks DWI Law Clinic was found not guilty after trial. Accused of DWI due to allegedly being under the influence of ma*****na, the court found the evidence presented did not rise to the legal standard and issued a ruling of acquittal at the close of all evidence.
On the stand, the arresting officer admitted that horizontal gaze nystagmus (HGN) tests are not good tests of looking for the impairment indicators if the alleged impairment is from ma*****na.
During the one leg stand test, the client was arguing with the officer & protesting his innocence and put his foot down immediately and yelled "See!" after he had just lifted it up off the ground.
The client then immediately restarted the test and was able to hold up his leg until the officer told him to put it down without losing his balance or swaying. But the officer alleged that the client putting his foot down was an indicator of impairment.
During all the Field Sobriety Tests the arresting officer held the client to a near impossible standard and the evidence was clear that his mind was made up before the tests even began.
Thanks to the acquittal, our client still has no criminal record AND he will not receive a suspension of his driving privilege.
