For certain disabilities, VA may presume that a condition is connected to military service when specific eligibility requirements are met.

Presumptive service connection can apply to certain veterans based on factors such as where and when they served, specific exposures, and the condition they developed.

But “presumptive” does not mean benefits are automatic. A veteran must still meet VA’s eligibility requirements and provide the information needed to support the claim.

Because presumptive conditions and eligibility requirements can vary, understanding how the rules apply to your individual service history is important.

For some veterans, service-connected disabilities can make it difficult or impossible to maintain substantially gainful employment. TDIU, or Total Disability based on Individual Unemployability, may provide another path to compensation at the 100% disability rate.

Veterans who qualify for TDIU can receive compensation at the 100% rate even though their combined schedular disability rating is less than 100%.

Eligibility depends on several factors, including the veteran’s service-connected disabilities and how those conditions affect the ability to work. Every situation is different. 🇺🇸

Can Your VA Disability Rating Change?

Not every VA disability rating is necessarily permanent. In certain circumstances, VA may review a service-connected condition and propose a change in the assigned rating.

There are also important protections that can apply depending on how long a rating or service connection has been in effect. For example, ratings continuously held at or above a particular level for 20 years generally receive significant protection from reduction, except in cases involving fraud.

The rules surrounding rating reductions and protected ratings can be complicated, so it is important to understand what applies to your individual situation.
