Celebrating a great result for a client! People with injury claims rarely think about subrogation, reimbursement claims or medical liens against their case but they are a real issue. Non-lawyers are not aware that once the case is won or settled, any organization who paid medical bills like health insurance, Medicare, Medicaid etc., have a claim for reimbursement for what they paid out.
One of the difficult parts of handling a claim (and why injured people need a lawyer) is because these reimbursement claims can eat up a settlement when all is said and done. In this case, using a line of caselaw against the lien holder, I was able to get rid of a lien of $116,000 against the recovery which gives the client and extra $116,000 in his pocket above the already good result we already achieved against the insurance on the bad driver. Needless to say, my client is very happy and that makes me very happy!
