Fun fact Friday. Texas legally recognizes common law marriage, also known as informal marriage, without requiring a traditional ceremony or license. To have a valid common law marriage in Texas, you must meet three conditions: (1) Agreement: Both people must agree that they are married; (2) Cohabitation: They must live together in Texas as a married couple; and (3) Holding out: They must tell or show others that they are married (such as using the same last name, signing leases together, or filing joint taxes). Texas law does not require you to live together for a specific number of years to form a common law marriage, but you must also be at least 18 years of age.
