Martocchio & Oliveira was the first law firm in New England to file a lawsuit against "Live it Up" Super Foods after the January 2026 recall of its Super Greens dietary supplements due to their potential contamination with salmonella.
The 24-page product recall lawsuit says that on or about January 15, 2026, Superfoods announced a voluntary recall of its Live It Up Super Greens, including the Original and Wild Berry flavors, due to possible contamination with salmonella. The case, citing the United States Food and Drug Administration (FDA), says that, to date, 45 illnesses and 12 hospitalizations nationwide have been possibly linked to the recalled Super Greens. Including the firm's client who suffer severe and life changing injuries by consuming the product.
The case alleges that Superfoods “uniformly misrepresented” its dietary supplements, including by claiming that the products contained “all of the good stuff” and “none of the bad stuff,” and that they were produced using “good manufacturing practices.” To the contrary, the filing alleges Superfoods failed to inspect or test the recalled products and concealed the salmonella contamination from consumers.
The lawsuit, citing the Centers for Disease Control (CDC), stresses that salmonella causes approximately 1.35 million illnesses and tens of thousands of hospitalizations each year. The case notes that although salmonella is only the second-most-prevalent foodborne illness, it is “the leading cause of hospitalizations and death from food poisoning.”
