USCIS published an update to their policy manual effective today. This policy indicates that, going forward, requests for evidence or notices of intent to deny will not be issued and instead, a case will be denied and a notice to appear in immigration court will be issued (for applicants/beneficiaries in the United States). Now more than ever, it is crucial that you document to the fullest extent all applications and provide all available evidence at the time you submit your case. Using an attorney that knows the law and the evidentiary requirements has always been important. Now more than ever it must be understood that the wrong help can be the most dangerous help.

USCIS publicó una actualización de su Manual de Políticas con vigencia a partir de hoy. Esta nueva política indica que, en adelante, en muchos casos USCIS podrá negar una solicitud sin emitir primero una Solicitud de Evidencia (RFE) o un Aviso de Intención de Negar (NOID). Además, para los solicitantes o beneficiarios que se encuentren en los Estados Unidos, una denegación podría ir acompañada de la emisión de una Notificación de Comparecencia ante la Corte de Inmigración (Notice to Appear – NTA).
Ahora más que nunca, es fundamental documentar completamente cada solicitud y presentar toda la evidencia disponible desde el momento en que se envía el caso. La carga de la prueba siempre ha recaído sobre el solicitante, pero esta actualización hace aún más importante que las solicitudes se presenten de manera completa y correctamente respaldadas desde el inicio.
Contar con un abogado que conozca la ley y los requisitos de evidencia siempre ha sido importante. Hoy, más que nunca, es indispensable comprender que la ayuda equivocada puede ser la ayuda más peligrosa.

In a 6-3 decision, the Supreme Court ruled that the Constitution guarantees automatic birthright citizenship to virtually all children born in the United States. This decision upholds more than a century of case law under the 14th Amendment. Attempts to undermine the foundation of the Constitution threaten our country’s fundamental democratic values. The Supreme Court just reminded us of how important the Constitution is to our democracy.

En una decisión tomada por 6 votos a favor y 3 en contra, la Corte Suprema dictaminó que la Constitución garantiza la ciudadanía automática por derecho de nacimiento a prácticamente todos los niños nacidos en Estados Unidos. Este fallo ratifica más de un siglo de jurisprudencia basada en la Enmienda 14. Los intentos de socavar los fundamentos de la Constitución amenazan los valores democráticos esenciales de nuestro país. Celebrating the wins! Yesterday we had 4 outcomes to celebrate! 2 cases won within the United States and 2 people granted approvals outside the United States. None of these cases was “easy;” an adjustment of status in front of the immigration judge, an adjustment of status with a fraud waiver and 2 immigrant visas with applicants who had prior immigration history. If the law allows you a way to your benefit, we will help you get there! WOO HOO!

Celebrando las victorias! Ayer tuvimos 4 resultados para celebrar: 2 casos ganados dentro de los Estados Unidos y 2 personas que recibieron aprobaciones fuera de los Estados Unidos.
Ninguno de estos casos fue “fácil”: un ajuste de estatus ante un juez de inmigración, un ajuste de estatus con un perdon por fraude, y 2 visas de inmigrante para solicitantes con antecedentes migratorios previos.
Si la ley le ofrece una vía para obtener su beneficio, nosotros le ayudaremos a llegar allí. WOO HOO!

A Federal Court issued an order today in a suit challenging four USCIS policies that had made seeking benefits for many non-citizens virtually impossible based solely on their countries of origin. In Dorcas International Institute of Rhode Island v. USCIS, the court declared all four policies unlawful and vacated them. This order was just entered today so it may be subject to appeal or a stay but we will keep you posted on any further developments.

The four policies struck down are:
• Global Asylum Hold Policy — a hold on all asylum and withholding-of-removal applications regardless of country of origin
• Benefits Hold Policy — a hold on benefit adjudications (green cards, work permits, etc.) for applicants from the 39 countries
• Comprehensive Re-Review Policy — re-review of already-approved applications for people from Travel Ban countries who entered on or after Jan. 20, 2021
• Country-Specific Factors Policy — Policy Manual changes making "country-specific facts and circumstances" a significant negative factor in benefit decisions

Un tribunal federal emitió hoy una orden en una demanda que impugnaba cuatro políticas del USCIS que habían hecho que solicitar beneficios fuera prácticamente imposible para muchos no ciudadanos, basándose únicamente en sus países de origen.
En el caso Dorcas International Institute of Rhode Island v. USCIS, el tribunal declaró ilegales las cuatro políticas y las anuló. Not everyone is qualified for asylum, or cancellation of removal, two common forms of relief requested in immigration court. But everyone deserves a fair and impartial jurist to give them due process through a full and fair hearing.

No todo el mundo reúne los requisitos para obtener asilo o la cancelación de la remoción, dos formas comunes de alivio solicitadas ante los tribunales de inmigración. For those of you with DACA, current processing times for renewal appear to be anywhere from 8-12 months. USCIS has removed processing times from their website citing “extended vetting” so there is no way to inquire as to actual timeframes. Please do not leave yourself unprotected. Renew your DACA early! If you also feel you may qualify for other options, please speak with an attorney prior to filing additional applications. The wrong help can have devastating consequences.

Today’s policy memo identifying adjustment of status as an immigration benefit that should only be granted if an applicant warrants favorable discretion is an attempt to override statutory law. I anticipate litigation will be fast as this is a complete overreach. For now, please contact an immigration attorney if you have an adjustment pending or are adjustment eligible. This will require in depth analysis on a case by case basis.

El memorando de política emitido hoy, que identifica el ajuste de estatus como un beneficio migratorio que solo debe concederse si el solicitante amerita una discreción favorable, es un intento de invalidar la ley estatutaria.
