What to do if you got stuck in the United States?
At the moment, many people cannot leave the United States, while their nonimmigrant status expired or is about to expire. COVID-19 crisis could be a qualifying reason to request an extension or a change of status to B-2 or sometimes B-1 visitor’s status. USCIS temporarily waived its requirement for original signatures. Of course, the administration is going to consider these applications on a case by case basis, as usual. However, recent USCIS notices seem to suggest that those applications may be adjudicated with some compassion. Even if you are late to file an application to change or extend your visitor status, file anyway and explain reasons for being late. On a case by case basis, USCIS always could and still can adjudicate an application favorably even if it is filed late for a qualifying reason. You may find some encouraging – albeit vague – language on the USCIS page for special situations. https://www.uscis.gov/humanitarian/special-situations
Many nonimmigrant workers are present in the United States pursuant to working visas, such as H-1B, L, E-1, E-2, E-3, TN, O-1, and others. In view of a looming economy slowdown, these workers are likely to face layoffs. A grace period of 60 days is available to these workers upon a cessation of their employment.
During the grace period a person is expected either to find a new job or leave the country. If neither outcome presents itself within 60 days, we recommend to apply for a change of status to a B-2 or B-1 visitor status. It is, of course, much better to file before the 60 days period expires.
If an employer wishes to retain a worker but cut the salary, then H-1B workers would require an amended petition.

Конечно, администрация сделала оговорку, что каждый случай будет рассматриваться индивидуально. Можно надеяться, что просьбы о продлении пребывания из-за кризисной ситуации сейчас относятся к категории специальных случаев и будут рассматриваться более благосклонно. Существенно также, что тем, кто опоздал подать такую просьбу, нужно подать её всё равно как можно скорее. Администрация не говорит прямо, но даёт понять, что кризис COVID-19 может служить уважительной причиной для опоздания.
У тех, кто находится в Америке по рабочей визе, и кого сейчас ожидает увольнение, есть 60 дней на то, чтобы выехать или найти другую работу. Если другая работа нашлась после 60 дней, то начать можно будет только после нового въезда. Пока что администрация не сообщила ни о каких послаблениях в этом отношении. Если 60 дней прошли, новой работы нет, и уехать нельзя, то мы рекомендуем подать прошение о смене статуса с рабочего на гостевой - до истечения 60-дневного срока. Причину нужно указать самую простую - вынужден оставаться в Америке из-за COVID-19 кризиса. Кто-то не может выехать, а кто-то, не ровен час, заболел или ухаживает за больным. Все эти причины - в высшей степени уважительные. При этом, даже если всё не так драматично, но вас, тем не менее, уволили, можно попросить о смене статуса на гостевой или даже деловой (ищу новую работу).
