Meet the next member of our team, Stephanie Slater!

As our Probate and Guardianship Department Manager, Stephanie has been a part of the legal industry for almost three decades. ๐Ÿ™Œ๐Ÿฝโš–๏ธ She is a Florida Registered Paralegal and is known for the way she empathetically guides and supports clients throughout the Probate and Guardianship process.

Stephanie is a Miami native and has an Associate of Science degree in Paralegal Studies from Miami Dade College and a Bachelorโ€™s degree in Public Administration from Barry University. ๐Ÿ“š

She loves being a wife and mom and spending time with her family and friends. ๐Ÿ‘จโ€๐Ÿ‘ฉโ€๐Ÿ‘งDuring her free time, you can find Stephanie attending concerts across Miami.

If you were to pass away while your children were still minors, then you will have to do more than select them as primary or contingent beneficiaries. Specifically, you may want to establish guardianship for your minor children.

A legal guardian would merely be responsible for managing any assets owned by your minor children. Guardians may be able to use assets from the estate to cover any of your childrenโ€™s expenses, but they would not be able to use estate funds to fund personal expenses and benefits. ๐Ÿ’ฐ

Meet our Real Estate Department Manager, Maggie Almonte who has been a part of the legal real estate industry for over 30 years. ๐Ÿ‘๐Ÿผ

Joining the team in 2017, Maggie leads the firmโ€™s real estate department. ๐Ÿก She oversees communication between buyers, sellers, and brokers. She also manages the administrative aspects of the transactions.

Before joining Mendez and Mendez, Maggie worked for a real estate firm and co-launched a title company. ๐Ÿ“‘

Outside of work, Maggie enjoys baking, cooking, and playing dominos. She is a proud mother of a classical pianist and has been married to her husband for over 20 years.

But, a trust may be beneficial to you for a few reasons.

One of the main draws is the privacy that a trust offers over a will. This is because for a will to be valid, it must go through probate court proceedings. Depending on the jurisdiction, these proceedings and documents may be made publicly available. ๐Ÿ”

Trusts, on the other hand, are a great option for those who prioritize privacy when it comes to their assets and distributions since trusts are typically not of public record.

Creating an estate plan is beneficial for a variety of reasons. But one of the main draws from having your affairs in order is to avoid dying without a will.

If you die intestate (without a will), your stateโ€™s laws of descent and distribution will determine who receives your property by default. ๐Ÿ‘ฉโ€โš–๏ธ

These laws vary from state to state but tend to favor distribution to your spouse and children. If you have no spouse or children, distribution would likely go to other family members. โš–๏ธ

The third-generation attorney focuses his practice primarily on probate and guardianship administration and litigation, estate planning, and civil litigation.

In general, depositions can be given by any competent person involved in the case.

You might assume that individuals in a guardianship would automatically be barred from offering depositions since the court might have previously found them to be legally incompetent. ๐Ÿ™‡๐Ÿฝ

But regardless of guardianship status, the court must still consider the competency of a potential witness.๐Ÿ‘ฉโ€โš–๏ธ

Thus, individuals that have been declared legally incapacitated for the purposes of a guardianship may still be found competent enough to offer testimony during a deposition. ๐Ÿ’ก

Meet Managing Partner Sergio L. Mendez! ๐Ÿ™Œ๐Ÿฝ

Sergio is a founding partner of the Law Offices of Mendez & Mendez and has over 35 years of experience practicing Probate, Guardianship, and Real Property Law.

He is AV rated by Martindale-Hubbell, the highest peer rating standard, and has handled hundreds of cases across the spectrum of civil litigation.

After graduating from Suffolk University Law School, Sergio was admitted to the Florida Bar in 1985. He then practiced with his late father, and co-founder of the firm, for over 15 years.

Sergio has been licensed for over 20 years by the U.S. Department of Treasuryโ€™s Office of Foreign Assets Control, as one of the few attorneys licensed to handle Cuban asset control regulation. He frequently travels to Cuba to represent Cuban heirs in U.S. Probate proceedings.

Beyond the firm, Sergio serves on the Cuban American Bar Associationโ€™s Pro Bono Foundation Board of Directors. He served as President of CABA in 1999 and on its Board of Directors for over 15 years. Sergio has also served as a professor at Florida International University teaching Wills, Trusts, and Estates.
