Meet the next member of our team, Stephanie Slater!

As our Probate and Guardianship Department Manager, Stephanie has been a part of the legal industry for almost three decades. 🙌🏽⚖️ She is a Florida Registered Paralegal and is known for the way she empathetically guides and supports clients throughout the Probate and Guardianship process.

Stephanie is a Miami native and has an Associate of Science degree in Paralegal Studies from Miami Dade College and a Bachelor’s degree in Public Administration from Barry University. 📚

She loves being a wife and mom and spending time with her family and friends. 👨‍👩‍👧During her free time, you can find Stephanie attending concerts across Miami.

If you were to pass away while your children were still minors, a trust for their benefit could avoid court proceedings. 👩‍⚖️

Trustees of a trust, for their benefit, could manage your minor children’s assets without a guardianship needing to be established. 🙌🏽

Also, trustees may use assets from a trust to cover any of your children’s expenses related to health, education, maintenance, and support (H.E.M.S.). 💰

It’s important for all adults to begin planning their estate. This is especially important if you have minor children. 👶🏽👧🏼

If you were to pass away while your children were still minors, then you will have to do more than select them as primary or contingent beneficiaries. Specifically, you may want to establish guardianship for your minor children.

A legal guardian would merely be responsible for managing any assets owned by your minor children. Guardians may be able to use assets from the estate to cover any of your children’s expenses, but they would not be able to use estate funds to fund personal expenses and benefits. 💰

Meet our Real Estate Department Manager, Maggie Almonte who has been a part of the legal real estate industry for over 30 years. 👏🏼

Joining the team in 2017, Maggie leads the firm’s real estate department. 🏡 She oversees communication between buyers, sellers, and brokers. She also manages the administrative aspects of the transactions.

Before joining Mendez and Mendez, Maggie worked for a real estate firm and co-launched a title company. 📑

Outside of work, Maggie enjoys baking, cooking, and playing dominos. She is a proud mother of a classical pianist and has been married to her husband for over 20 years.

Many people assume that trusts are only beneficial to high net-worth individuals/ families since trusts are costly to prepare and maintain. 👨‍👩‍👧‍👦

But, a trust may be beneficial to you for a few reasons.

One of the main draws is the privacy that a trust offers over a will. This is because for a will to be valid, it must go through probate court proceedings. Depending on the jurisdiction, these proceedings and documents may be made publicly available. 🔍

Trusts, on the other hand, are a great option for those who prioritize privacy when it comes to their assets and distributions since trusts are typically not of public record.

Creating an estate plan is beneficial for a variety of reasons. But one of the main draws from having your affairs in order is to avoid dying without a will.

If you die intestate (without a will), your state’s laws of descent and distribution will determine who receives your property by default. 👩‍⚖️

These laws vary from state to state but tend to favor distribution to your spouse and children. If you have no spouse or children, distribution would likely go to other family members. ⚖️

A state’s laws may or may not reflect your actual wishes. 📝

Daniel joined the firm in 2014 after graduating with honors from St. Thomas University School of Law.
 
The third-generation attorney focuses his practice primarily on probate and guardianship administration and litigation, estate planning, and civil litigation.
 
Daniel has successfully participated and argued several appeals in the Third District Court of Appeals. He is also a title agent for Old Republic National Title Insurance Company and represents buyers and sellers in real estate transactions.
 
A graduate of Belen Jesuit Preparatory School, Daniel currently serves as the Chairman for the Belen Alumni Lawyers Section. He has previously served on the Board of Directors of the Cuban American Bar Association.

In general, depositions can be given by any competent person involved in the case.

You might assume that individuals in a guardianship would automatically be barred from offering depositions since the court might have previously found them to be legally incompetent. 🙇🏽

But regardless of guardianship status, the court must still consider the competency of a potential witness.👩‍⚖️

Thus, individuals that have been declared legally incapacitated for the purposes of a guardianship may still be found competent enough to offer testimony during a deposition. 💡

Meet Managing Partner Sergio L. Mendez! 🙌🏽

Sergio is a founding partner of the Law Offices of Mendez & Mendez and has over 35 years of experience practicing Probate, Guardianship, and Real Property Law.

He is AV rated by Martindale-Hubbell, the highest peer rating standard, and has handled hundreds of cases across the spectrum of civil litigation.

After graduating from Suffolk University Law School, Sergio was admitted to the Florida Bar in 1985. He then practiced with his late father, and co-founder of the firm, for over 15 years.

Sergio has been licensed for over 20 years by the U.S. Department of Treasury’s Office of Foreign Assets Control, as one of the few attorneys licensed to handle Cuban asset control regulation. He frequently travels to Cuba to represent Cuban heirs in U.S. Probate proceedings.

Beyond the firm, Sergio serves on the Cuban American Bar Association’s Pro Bono Foundation Board of Directors. He served as President of CABA in 1999 and on its Board of Directors for over 15 years. Sergio has also served as a professor at Florida International University teaching Wills, Trusts, and Estates.
