CAREGIVER AGREEMENTS

🌿 Caring for a Loved One at Home? You May Be Entitled to Compensation — and It Can Actually Help with Medicaid Planning!

Our firm believes that family caregivers are unsung heroes. Whether you’re helping Mom with her medications, driving Dad to appointments, or providing round-the-clock support for a loved one with dementia — that work has real value.

That’s where a Family Caregiver Agreement comes in, and it’s one of the most meaningful documents we help families create.

💛 What is a Family Caregiver Agreement?
It’s a formal, written contract between a family member (the caregiver) and their loved one — documenting the care being provided and establishing fair compensation for that care.

✅ Why does having an attorney draft it matter?
A handshake agreement or informal arrangement simply won’t hold up when Medicaid enters the picture. To be recognized as a legitimate transfer of assets — rather than a gift that could trigger a Medicaid penalty — the agreement must be:

• In writing and signed before care begins
• Reasonable in scope and compensation (based on what a professional caregiver would earn)
• Properly structured to reflect West Virginia Medicaid guidelines

Our social workers help assess the actual hours and level of care involved, so the agreement reflects reality — not guesswork.

🧠 How does this affect Medicaid eligibility?
When a loved one eventually needs nursing home care and applies for Medicaid, the state looks back 5 years at all financial transactions. Payments made without a proper caregiver agreement can be treated as improper gifts — potentially delaying eligibility for months.

A well-drafted agreement means those payments were earned income, not gifts. That protects your family and honors the caregiver’s sacrifice. 💪

🏡 The bigger picture…
At our practice, we don’t just draft documents — we sit with families. Our dementia guides and social workers help you understand what stage of care your loved one needs today and plan for what’s coming. Because the best legal plan is one that fits your whole family’s story.

If you’re caring for a parent or spouse at home, let’s talk before it’s a crisis. A simple conversation now can protect your family for years to come.

‼️DIVORCED? Better update your documents!

Divorce is STRESSFUL! When you come out on the other side, it’s important to meet with an estate planning attorney for a “document check-up.” You don’t want to risk your ex calling the shots if you lose capacity or taking a part of your estate if you die!

The Significance of a Financial Power of Attorney

🤔Most people believe that if their spouse loses capacity from an accident or cognitive decline that they can access all financial accounts as a spouse. The problem occurs when the accounts are not jointly held, such as an IRA or 401k. 🚫No power of attorney means no access.

More problems occur if a joint asset, such as a home, has to be sold. 🚫No POA, no sale.

A basis estate plan includes a financial power of attorney. Meeting with an attorney to fully understand estate planning documents, what you need and how they work, before you sign. can save you thousands of dollars and hours of frustration.

At Good Grief Law, once we create your documents, we update them over the years as needed for no charge. As a holistic estate planning and elder law firm, we will also be there for you as you face new challenges as you age.

Give us a call for your FREE estate planning consultation to get the tools 🛠️ in place to make life easier for you and your family.

The 3-midnights admission is imperative to get Medicare to pay for rehab at a skilled nursing facility. We frequently advocate for clients who are denied admission or pushed out too early.

Our team at Good Grief Law has elder care coordinators. Most people have not heard of an elder care coordinator. They are the people the family hire when the adult children realize their parent can no longer manage on his or her own and they live three states away or work full-time and they need somebody on the ground to handle the doctor visits, the medication management, the home assessment, the conversations with the assisted living facilities, the insurance claims, and care in the home. Care coordinators know the system. They know the struggle.

If you are helping to care for an aging parent and are feeling overwhelmed, call us. We may have the perfect support options you’ve been looking for.
