A woman with a temporary restraining order attempted to flee the abusive boyfriend, which resulted in his assaulting her and threats to kill.

Melissa Kiefer, LSNWJ's Morris Family Justice Center attorney represented. LSNWJ's Staff Interpreter Carolina Chia interpreted, translated and transcribed hours of messages and video recordings, and testified in court to support the accuracy of the translations.

The abuser filed a cross-complaint, and the matter proceeded to trial, while our client was working with prosecution in the criminal matter against him. The matter ended with the defendant's guilty plea, voluntary dismissal of his cross-complaint and concession to her need for restraining order. Our client and her child safely entered transitional housing and is receiving other supportive services to help the family transition to safe independence.

LSNWJ attorney Grace Kelly has been nominated by the Warren County Bar Association for the prestigious NJSBA Charles Hollenbeck Award.

Grace is the Managing Attorney of our Warren County office in Belvidere, and the LSNWJ Family Team Leader.

The award is for government or nonprofit lawyers who serve the needs of the legal community, and have served with diligence, competence and dedication to the profession.

LSNWJ has been awarded a number of new grants which may expand access to our legal services, for people who identify with or have ever been diagnosed with an opioid or substance use disorder.

As always, we cannot provide assistance in current criminal matters. We do offer a wide range of civil legal services which people commonly need.

We offer legal advice, representation, and other services for eligible people in our five counties for these needs:

expungement of criminal records;
powers of attorney, wills, and advance health care directives;
legal help for tenants;
legal help with government-provided entitlements which have been denied, reduced, or terminated, sanctions and overpayments, including
TANF,
GA,
Emergency Assistance and Temporary Rental Assistance,
Food Stamps (NJ SNAP),
Medicaid,
SSI;
Unemployment Insurance Benefits;
debts, foreclosures, auto repossession;
and family law.

Under New Jersey law, amounts under $500 in accounts are not subject to levy, pursuant to N.J.S.A. 2A:17-24. Such small amounts are considered necessary for the most basic daily living expenses, and are therefore protected from over-aggressive collectors in an effort to prevent utter destitution of individuals.

However, banks consistently freeze accounts despite the State Statute, since it is not mentioned as an exemption in the Treasury Regulations that banks follow.

A recent case involved a judgment creditor's levy on the bank account of a person with disabilities, who had just obtained housing after homelessness.

LSNWJ attorney Gary Silvestri represented in the case, and filed an Objection to the levy on notice to the creditor and the bank. The Court signed an Order mandating that the Bank shall not freeze the debtor’s account for any additional levies when the account balance is $500.00 or less.
